辩护律师的程序权利及保障

【摘要】 现代各国都规定，在刑事诉讼中，被指控人除有权自行辩护外，还有权委托辩护律师为自己辩护。辩护律师作为辩护人参与刑事诉讼，对于被指控人辩护权的行使具有重大意义。辩护律师参加刑事诉讼，是保护被指控人合法权利、维护诉讼平衡、促进司法文明公正的重要途径。辩护律师制度是否完善，不仅是衡量一国刑事诉讼制度科学化、民主化的重要标尺，而且反映了该国的民主和法治的水平。如何赋予辩护律师科学合理的诉讼程序权利，保障辩护律师在刑事诉讼中发挥最积极的作用，是我国刑事诉讼制度现代化过程中必须回答的问题。本文较为深入地研究了传统文化与民族心理等精神性因素，对于辩护律师程序权利的重要影响；借鉴了其他国家以及国际社会在辩护律师程序权利方面的有益内容：并且较为充分地考虑了与辩护律师程序权利相关的我国的现实国情。在此基础上，从科学性与现实可能性相结合的角度，本文就当代中国辩护律师程序权利的现代化，提出了有益的构想。更多还原

【Abstract】 Today many countries proscribe that accused person have the rights to delegate the defence attorneys to defend for him besides having the rights to defend for himself. The defense attorneys’ participation in the criminal proceedings is very important for the effects of the accused persons’ defence right. The defence attorneys’ participation is an important way to protect the legal rights of the accused persons and realize the justness of jurisdiction and improve the democracy of the society. Whether the system of defence attorney is perfect is an important criteria to determine whether the criminal proceedings is scientific or not and whether the criminal procedure is democratic or not, and furthermore it reflects the situation of the democracy and administration of law in the country. How to endow the defence attorneys with scientific and reasonable procedural rights and how to safeguard them and make use of them to helpful in criminal procedure are important questions we must reply to in the course of the modernization of the system of criminal proceedings in our country. Firstly, this article deeply investigates the important effect that spiritual factors such as traditional culture and national psychology have on the procedural rights of defence attorneys. Secondly, it introduces the relevant provisions in other countries and in international society. Thirdly, it thinks over the situation in our country that is relevant to the procedural rights ofdefence attorneys. Finally from the aspects of combination of science and reality this article points out helpful suggestions about the modernization of procedural rights of defence attorneys in our country.更多还原
