【摘要】 职务侵占罪是一种古老的财产犯罪，在整个侵犯财产罪体系中占有重要地位。我国刑法学界对职务侵占罪的研究起步较晚，司法实践中存在许多疑难问题。本文从职务侵占罪的立法沿革入手，概述了古今中外职务侵占罪的立法简史，尤其是通过循着我国贪污罪的立法线索，总结了新中国职务侵占罪立法的从属、萌芽和确立三个阶段。本文最大的特点在于运用大量现行的法律规定和司法解释，深入剖析了我国现行刑法典第271条的理论和实践问题，如职务侵占罪的概念、构成特征、刑事责任、职务侵占罪与贪污罪之转化，以及国有单位中非从事公务人员、国家控股、参股公司人员、承包国有公司、企业人员、乡镇企业人员、农村基层组织人员、公司、企业或者其他单位人员共同犯罪的法律适用问题等，并对一些存有争议的问题发表了自己的看法。更多还原

【Abstract】 Crime of position encroachment is a sort of old and important crime of property violation in the whole system of crime of property violation.It’s later to start reserching crime of position encroachment in Chinese criminal jurisprudence field,and there is a lot of suspicious problems in judicial practice.This article generalizes ancient,modern,Chinese and foreign legislative history of crime of position encroachment,especially,sums accessory,origin and establishment stages of legislation of crime of position encroachment of New China.The most obvious speciality in this article is,with a lot of current legal provisions and judicial interpretations,analysing searchingly some theoretical and practical problems of Article 271 of Chinese current criminal code,such as conception,constitutive character,criminal responsibility of crime of position encroachment,transformation from crime of position encroachment to crime of corruption,application of law to some special persons,etc.Furthermore,it expresses its opinions to some questions at issue.更多还原
