【摘要】 产品责任作为现代化大规模生产的产物，是现代社会所必然出现的一种法律现象，在世界各国的法律理论和实践中都受到了很高程度的重视，产品责任已成为世界性的问题。但我国目前的产品责任制度还不成熟，缺乏规范性、统一性，有许多问题亟待解决。 本文就此问题提出了完善的初步构想。 首先，明确了产品责任的概念、法律特征及性质，阐述了产品责任制度的历史发展。然后，对主要国家的产品责任制度内容进行系统的分析，透视了国际产品责任制度的发展趋势和新动态，导入了先进的研究成果。最后，运用比较的方法、法解释的方法、经济分析等科学的理论研究方法，完成我国产品责任制度借鉴与完善。我国已经加入世界贸易组织，融入世界范围内的经济发展契机中，完善产品责任制度将对开放中国的市场起到进一步的促进作用，对提高我国产品在世界市场中的竞争力，促进市场经济的发展起到重要作用。更多还原

【Abstract】 As a result of modern great production,products liability is inevitable law phenomenon,which is attached importance to in the law theory and practice by all the countries in the world,it has been a worldwide problem,but it hasn’t been mature and there are many law matters to be resolved in our current law institution,such as lack of standard and union,etc.This article tries to interpret the elementary idea to resolve problems.To begin with,the article defines concept,law character of product liability,and interprets history development of products liability institution. Moreover,it researches the contents of institues of main countries and analyses development and movement of international products liability institution,which is the base of perfect products liability in our country. Finally,it accomplishes the element opinion with the theory research method of comparison,law interpretation and economy analysis,It brings up the idea of contents of perfect products liability institution,facing the chance that our country had joined WTO and go into economy development all over the world,perfect products liability will promote the open Chinese market,promote competitive ability of our products in the world market,promote the development of economy market.更多还原
