论精神损害赔偿制度

【摘要】 在世界各国都注重人权的背景下，精神损害赔偿制度得到了引人注目的发展。随着社会的发展，我国对精神损害赔偿制度的立法已滞后于社会形势的发展，亟待完善。 本文从精神损害赔偿的意义、性质与功能；适用范围；数额确定；现行立法的缺陷及完善办法四大方面阐述我国精神损害赔偿制度。文章重点结合最高人民法院《关于确定民事侵权精神损害赔偿责任若干问题的解释》，阐述了精神损害赔偿的范围，研究了精神损害赔偿金额确定的原则和计算方法，参考国外立法例以及我国现行精神损害赔偿制度存在的不足之处，提出了关于完善我国精神损害赔偿制度的几点立法建议。更多还原
