【摘要】 环境行政合同是环境资源法学研究中的一个全新领域，无论理论研究如何，各国在解决环境问题的过程中都自觉不自觉的运用了环境行政合同，本文正是以实践为切入点、以行政合同的理论为依托、借鉴国外的一些先进经验和做法，探索适合中国国情的环境行政合同制度。 在我国，采用合同的方式解决行政管理问题已经相当普遍，但是把传统的民法和行政法理论结合起来的理论研究却明显滞后，在环境保护领域中更是如此，这种状况不利于我国环境保护事业的健康发展，所以应当加强环境行政合同的理论研究。 本文共分九个部分，首先简要地介绍了环境行政合同的历史发展，接着阐述了环境行政合同的概念、分类、特征、作用和意义，然后分析了民法相关原理在环境行政合同中的应用以及环境行政合同的主要内容、救济途径，最后针对我国目前的实际情况，提出了适合我国国情的环境行政合同制度。更多还原

【Abstract】 It is a whole new field of research for environmental administrative contract in environmental resource rule. No matter how theoretical research develops, environmental administrative contract has been applied in solving environmental problems conscientiously and unconscientiously by many countries. The essay explores a suitable system of environmental administrative contract which can fit Chinese situations, by the enter point of practical demands and on the basis of the theory of administrative contract.In our country, it is much too common in the method of solving administrative problems with contracts. But it obviously lagged in the theoretical research of connection traditional civil law with administrative law. This phenomenon is more serious in the field of environmental protection which will be harmful for the normal development of the cause of environmental protection in our country. So we must strengthen the theoretical research of environmental administrative contract.The essay has 9 parts. First of all, the author introduces the development of environmental administrative contract briefly, next, elaborates the conception, classification, characteristic, function and significance, third, analyses the related theory of civil law which applied in environmental contract and introduce the main contents, the way of repair of environmental administrative contract, and at last, raises the system of environmental administrative contract that fits our country’s situations.更多还原
