【摘要】 我国既已加入世界贸易组织，就必须遵守世界贸易组织的法律制度。保险业作为我国服务贸易的重要部门，已按照我国加入世界贸易组织的承诺对外开放，因此也应当遵守相应的制度。学者们认为我国的保险法制存在诸多问题，需要完善，使之和世界贸易组织的法律制度相一致并使之符合在加入世界贸易组织之后的形势下保险业发展和监管的需要。但是，如何完善我国的保险法制，学者们尚未进行深入、系统的研究。 本文第一部分从世界贸易组织庞大的法律框架中整理出有关保险业的法律制度，分析其特点，概括其基本原则，并分析了其对我国的保险业和保险法制的影响。本文第二部分分析了我国的保险业和保险法制的现状，从整理、分析中得出完善我国保险法制的必要性和紧迫性的结论。在前两部分的基础上，笔者运用比较和分析的方法，在第三部分提出了完善我国保险法制的原则，对我国保险法制体系、保险监管法律制度以及保险合同法律制度的完善进行了论证。更多还原

【Abstract】 Now that China has been a member of World Trade Organization (WTO), we must observe the legal system of WTO. Insurance trade, as an important part of service trade of China, must observe the related legal system of WTO, since it has been opened to the members of WTO within our commitments to WTO. Scholars hold the opinion that our insurance legal system must accord with the legal system of WTO and meet the need of insurance trade development and the need of regulation of insurance trade with China’ s accession to WTO by el iminating the defects. But how to improve our insurance legal system hasn’ t been deeply and systematically studied.At the first part of this dissertation, insurance legal system is drew out from the tremendous legal system of WTO. And then, the author analyzes insurance legal system’ s characters, summarizes its principle and probes with its effects on insurance trade and insurance legal system of China. At the second part, the necess ity and emergency of improving our insurance law legal system is concluded by analyzing the state of our insurance trade and insurance legal system. On the basis of the two parts, with the method of comparison and analysis appl fed, the author suggests the principle of improving the insurance legal system of China and puts forward some ideas to improve the framework, the regulation system and the contract legal system of our insurance legal system at the third part.更多还原
