我国房地产按揭法律问题研究

【摘要】 按揭作为一种担保方式,从上世纪90年代传入我国大陆,为繁荣和发展我国房地产金融市场作出了巨大贡献。但是,按揭的内涵和外延无论在学术界、实务界和司法界均十分混乱。本文通过对按揭相关法律问题的研究,旨在促进我国房地产按揭法律制度的建立和完善。 首先,本文从按揭的词源说起,研究了英美法系和香港法中的按揭制度,并对我国大陆房地产按揭的含义进行了解释和规范,区分了按揭的广义、狭义概念,确立本文的研究范围在于按揭担保。 其次,研究了我国房地产按揭法律关系的主体,内容和客体,认为按揭法律关系的客体不是房产(物),而是对按揭标的物的所有权的期待权,是一种财产权益。 第三部分,通过比较按揭与所有权保留、权利质押、抵押、让与担保的异同,认为我国房地产按揭的法律性质应定位于让与担保。 第四部分,对按揭权的实现,按揭人利益的保护,按揭纠纷的处理等实践问题进行评析。 第五部分,指出确立科学的让与担保制度是理清我国房地产按揭制度的前提和基础,在此基础上对我国房地产按揭立法所应遵循的原则及应确立的制度进行了探讨。

【Abstract】 Mortgage, as one way of guarantee, has made great contribution in promoting and developing the financial market of real estate industry in China since 1990’s when it was imported to the main land. However, the meaning of this word is confusing to people in different field. This article aims to help the establishment and bettering of the legal system of mortgage in the real estate industry in China, through discussing on the related cases.First of all, speaking from the source of mortgage, the author conducted research into the mortgage system in British-America Law and Law of Hong Kong, explained and standardized the meaning of mortgage in the real estate industry in China, distinguished the different meaning between its broad sense and narrow sense, and established mortgage guarantee as the object that will be discussed in this article.Secondly, the author researched on the main body, content and object in the mortgage of the real estate industry of China, and concluded that the object in mortgage is not the house property, but the expectant to the ownership of the mortgage target, it is a property rights.Thirdly, by comparing the similarity and difference between mortgage and ownership reservation, pledge, charge and release, the author drew the conclusion that the legal character of mortgage in Chinese real estate industry orients to release.Fourthly, the author commented on the realization of the right ofmortgage, the protection of the interest of mortgager and the handling of mortgage dissension.In the fifth part, the author pointed out that reasonable releasing system is the precondition and basis of scientific mortgage system in the real estate industry. Meanwhile, the author carried out discussions on the principles that should obey and the regulations should set up in the legislation of mortgage, in addition to giving the individual idea of bettering the mortgage system in Chinese real estate industry.
