关于网络版权保护的若干思考

【摘要】 网络版权保护是知识产权法的新问题，它向我国的传统版权提出了种种挑战。本文从以下三个方面加以论述：一、信息网络传播权及其保护。它主要介绍了有关网络传播权的国际立法、设立网络传播权的种种争议和我国新版权法对信息网络传播权的规定。二、网络作品著作权侵权及其保护。它主要介绍了对网络作品的著作权的侵权类型：擅自下载、上传网络作品；侵犯网页著作权；链接引起的著作权保护问题；规避著作权保护的技术保护措施。三、网络上的邻接权及其保护。本文结合具体实例从理论上进行了归纳和总结，对以上问题作了初步的研究。加强网络版权的法律保护，不仅可以维护版权人的合法利益，而且也将促进世界文化的传播。所以这在当前已成为世界各国的共识。与许多发达国家相比，我国在此方面尚有很大差距。因此为了促进我国文化事业的发展，发挥网络优势，应大力加强有关网络版权的法制建设。更多还原

【Abstract】 Copyright protection on Internet is a new question of intellectual property protection. It challenges the traditional copyright in our country. In the article, I will discuss the three questions. At first. I will tell of the right of on-line communication on information and the protection on it. Under the international copyright rules and the rules of many countries there are many stipulations on it. In order to adapt to international situation it has been legislated in our copyright rule argument. Second. I will say about infringement of copyright on the on-line works and the protection on them. There are four categories of infring acts: unauthorized uploading and downloading on-line works: infringing the copyright of the page on Internet; hyper linking causes the questions of the copyright; escaping the measure of technical protection on copyright. At last I will tell on-line neighboring right and protection on it.To strength the lawful protection of the Internet copyright is good not only to defend the copyright holder’s legitimate interests but also to advance the spread of the international culture, which has become the well-recognized in the world, nowadays. Comparing with the developed countries, China has a pronounced distance in this aspect. Therefore, in order to advance the development of our country’s cultural cause and make the best of advantage of the Internet, it is necessary to strengthen the building of legal system about Internet copyright.更多还原
