【摘要】 本文从三个方面入手对完善我国外国投资立法作了探讨。 第一章以统计数字论述了国际直接投资的发展趋势及其对国际投资立法的影响，说明世界经济一体化、国际投资自由化已成为当今世界的潮流。 第二章论述了我国利用外资的概况和涉外投资法的发展。这一章从分析我国吸收外国投资的历史发展着手，结合利用外资的各个阶段的特点，概要说明了我国涉外投资法律制度的形成和发展。 第三章论述了我国外资立法体系的完善。现阶段我国利用外资的主要方式仍然是设立外商投资企业，相关立法与现实情况存在一定距离。本章分析了我国外商投资法律体系的不足，然后根据国际投资发展及立法趋势提出了改革和重构我国外商投资法律体系的建议。更多还原

【Abstract】 This article approaches the subject of the consummation of foreign investment legislation in China. It is divided into three parts:The first chapter discusses the development of international foreign direct investment and its influence on the international investment legislation through statistical figures. It proves that the integration of world economy and the liberalization of international investment are the trends of the world now.The second chapter discusses the general situations of foreign investment and foreign investment legislation of China. Setting about with the discussion on the development of the attraction of foreign investment, together with the features of various stages of utilization of foreign investment in China, this chapter briefly explains the shaping and development of the foreign investment law system of China.The third chapter discusses the consummation of the foreign investment legislation system of China. At present, setting up foreign founded enterprises is still the major channel of utilizing foreign investment and there is also a distance between the related laws and facts. It stresses on the shortages of the present foreign investment law system of China and, based on the development of international investment and the trend of legislation, it puts forward the suggestions on the reform and re-construction of present foreign investment law system of China .更多还原
