【摘要】 本文通过对沿海国海域管辖权的研究，分析了沿海国的刑事、民事管辖权的有关内容与实践，了解了国际公约、惯例中有关管辖权的规定，结合国际上发生的典型案例，对当前最具关注的海洋环境污染问题和具有争议的船舶案件管辖权、专属经济区管辖权问题，作了重点和较为详细的论述；对管辖权的冲突原则等提出了自己的见解。指出海域管辖权对捍卫国家主权、维护海洋权益、保护生态环境、开发海洋资源以及船舶安全、航海秩序等具有重要意义。结合我国管辖权的立法、司法实际，阐述了我国在这一领域与国际公约、惯例相统一的过程中，在具体立法上存在的不足，并提出一点建议。更多还原

【Abstract】 In this thesis , through the study of the jurisdiction of coastal nations, the analysis of the content and practice of jurisdiction in penal law and civil law in coastal nations, which the reference to the international typical cases, the most concerned present pollution problems on ship cases and problems on exclusive jurisdiction of economic zone are discussed detailedly; The views on the principle of conflict is raised. In regard to the practice of legislation and jurisdiction , suggestions are made on the defects of legislation in the course of the consistence with the international pacts and convention.更多还原
