【摘要】 随着世界贸易自由化和经济全球化的发展，倾销被很多国家作为占领它国市场的一种重要手段，我国也面临国外产品倾销的对相关产业造成的损害，研究反倾销法律理论与实践，进一步完善我国的反倾销法规，保护国内相关产业，是一项具有重大现实意义的课题。 本文对反倾销法的一般理论问题进行了详尽分析。通过对倾销概念的分析，提出倾销认定的三个条件：一是一国产品以低于正常价值的价格进入另一国市场内，该出口国产品被视为倾销产品；二是该倾销产品对进口国相似产品工业造成实质性损害或产生实质性损害威胁，或实质性地阻碍某一相似产品工业的建立；三是倾销与损害有因果关系。通过对反倾销国内法和反倾销国际法的产生和发展的考察，概括了反倾销法的特征，总结了反倾销立法的规律和经验，强调了反倾销法在国际贸易中的重要作用。 本文还分析了国际反倾销形势及世界贸易组织反倾销立法内容，针对我国即将加入关贸总协定的现实，全面透彻地分析了国际反倾销法的立法精髓并予以为鉴。 本文研究的重点是如何完善我国的反倾销立法。通过对外国产品倾销状况及中国反倾销现状的分析，肯定了我国反倾销＿法发挥的积极作用，同时指出我国在反倾销措施和反倾销立法方面存在滞后性，明确了中国反倾销立法的必要性。 本文对中国反倾销法的立法概况及中国现行的反倾销实体－法内容和中国反倾销程序法内容作了具体分析，针对我国反倾＿销立法存在的问题，提出了完善中国反倾销法的具体建议。在法律体例方面，提出将来反倾销立法体例上可采取最高立法机构全国人大直接立法为主，国务院鹏立法和具体行政部门解＿释性立法为辅的形式，构成比较完善的反倾销法律体系。在实体性问题方面，提出结合我国国情增加地区性市场条件，对地－区产业进行有效的保护；在认定倾销的三个条件以外，附加公共利益条件的考虑，合理审查反倾销的必要性。在龄性问题方面，建议我国的反倾销法应补充规定申诉人的资格要求；在机构设置上建议我国今后的反倾销机构作一调整，明确责任，提高效率。另外，建议我国反倾销法增加反倾销司法审查规定，还司以设立专门国际贸易法院，审查包括反倾销在内的国际贸＿易案件。这些建设性的意见均能有助于我国反倾销法的进一步。完善。更多还原

【Abstract】 With the development of world trade liberalization and economic globalization, dumping as an important measure for occupying other country抯 market by many nations, China is also confronted with the harm on relevant industries resulted from foreign products dumping. So, it is of realistic significance to research the anti-dumping theory and practice, to perfect further our anti-dumping mles ®ulations and protect related industries. This paper, conducts a detailed discussion on the general theory of the anti-dumping law, which, through analysis of the anti-dumping conception, puts forward 3 conditions in identifying the anti-dumping: Firsriy, one counUy抯 products enter another countr~s market at the price lower than that of normal value, the products are viewed as the dumping products; Secondly, the dumping products lead substantive harm or substantive hamiful threats, or substantive obstacle of the establishment of similar industries to the imported country; Thirdly, dumping has causality with the harm. The paper outlines the characteristics of the anti-dumping law, sums up the law and experience of anti-dumping legislation and slresses the important role of auti-dumping law in international trade by the investigation of the national laws and international laws for anti-dumping. Also, the paper analysis the international anti-dumping situation and legislative contents of the world trade organization(WTO), and analysis the legislative quintessence of the international anti-dumping laws in an overall and thorough manner and take lessons from China抯 entiy into the GAiT The key point of this paper researches is how to perfect China抯 anti-dumping law Afier the analysis of foreign products dumping situation as well as China抯 present conditions in anti-dumping, it points out the active role of China抯 anti-dumping law and meanwhile affirms the hysteresis China抯 anti-dumping measures and legislation and defines the necessity of China抯 anti-dumping legislation. This paper concretely analysis the legislative conditions of China抯 anti-dumping law, the contents, of China抯 current anti-dumping subs iantive law and China抯 anti-dumping procedure law, advancing some detailed suggestions to perfect China抯 anti-dumping law in the ~ view of the existing problems in China抯 anti-dumping legislation. (1) In respect of legal cases, it points out that in future抯 anti-dumping legislative cases, it is proper to take the direct legislation of the supreme legislative body the NPC as the dominated factor, and the state council抯 governmental legislation and concrete administrative 9 departments explanatory legislation as the subsidiary factors to constitute amore perfect anti-dumping legal system. In respect of substantive problems, it puts forward to increase regional market conditions in combination with our national characteristics and to conduct effective protections for the regional industries; Besides the 3conditions identifying the dumping, consideration of public interest conditions should be added and the anti-dumping necessity should be rationally examined.
