中国人力资本市场中的企业劳动关系研究

【摘要】 本文以人力资本市场为背景,对处于转轨时期的企业劳动关系进行研究。 本文共分五个部分。第一部分分析人力资本市场发育现状、特征,表现为:(1)劳动力结构不合理,劳动力供求呈现两种状况;(2)市场机制较为紊乱;(3)职业中介组织有待完善;(4)政府角色定位有待调整。人力资本市场的不成熟对劳动关系产生了三个方面的不利影响。第二部分以劳动关系理论为基础,分析企业劳动关系特征:(1)合作是主流,冲突不断升温;(2)劳动关系呈现复杂性;(3)劳动关系呈现不稳定性;(4)工会的功能发挥不力。提出从劳动合同、工会、劳动争议处理机制入手来规范劳动关系。建立在前两部分的理论基础和框架上,后三部分则从理论和实际两方面分别对劳动合同的现状、工会的功能和劳动争议处理机制的状况进行分析,找出各自存在的诸种问题,借鉴西方市场经济发达国家的成功经验,结合中国实际,探讨理论对策,在完善劳动合同制度上提出了六条措施,在工会制度的健全上提出四个对策,在重新设计劳动争议处理体制上,提出“先予调解,裁审分轨,各自终局”双轨制。

【Abstract】 I’d like to research the sth about the enterprise labour in the period of altering trail in the background of human and capital market, and therefore now let me introduce the following statements to you0 I will divide my remarks into five sections0 The first part is about the analysis of growth conditions and feature of human and capital market, The problems lie in the fact that firstly the structure of labour force is not rational and besides the supply and demand of labour force is incordinated; and secondly the system of the market is chaotic and thirdly the media organization of occupation is to be improved and fourthly the role of government guidance is to be adjusted0 In a word, the immature elements of human and capital market have caused three unfavourable effects to the labour relation0 The second part refers to the exposition of characteristics of labour relation in enterprise on the basis of theory on the labour relation0 There are four disadvantages of which the first is that conflicts intensifiy step by step in the trend of cooperative practice, and the second one lies in the complicated relation of labour and the third in the unsteady tendecy of labour relation and the fourth in ineffective function of labour unions And accordingly I put forward suggestions that handle systems to rationize the labour relation like labour contracts and labour union and labour dispute should be based on the two theories mentioned above0 The remainders of other three sections of my statements focus on the detailed narration of the persent conditions of dealing with labour contracts and the function of labour union and labour disputes0 I assure We shall combine theory with practice managing to find out various problems in each country so as to absorb the successful experiences from the developed countries in the west0 Thus we are able to explore chinese society by some theoratical tactics0 There are six measures to better labour contract system and four tactics to improve the labour union system and finally in order to redesign the system of labour disputes we have created Double Trail System to compromise contradictions to separate trail by judge and to refine the separate finality0
