【摘要】 在讨论网络信息的版权问题上，涉及几个利益相互对立的社会集团。对这些社会集团进行明确，并对其利益及相应权利分别加以分析有着重要的意义，因为他们在网络信息版权问题上的联合与分立取决于他们如何期待版权制度的影响，而这也正是国家进行制度分析和变革的一项必不可少的工作。 本文主要运用类比、归纳等逻辑方法，以点带面地抽取与网络信息版权制度中的集团利益相关的典型问题，对其进行较为详细的分析，从中探求网络空间各个集团的利益的重新平衡。 本文由五部分内容构成。第一部分讨论了网络空间对版权制度的挑战。网络技术打破了传统的版权利益平衡，世界上许多国家都对此采取了不同的措施。本章以版权制度发展比较完善的美国和西欧为代表，分别介绍各自的解决模式并加以评析，在此基础上，提出一种新的设想，将与网络信息有关的各方代表划分为三大利益集团，以重新寻求新技术条件下各方的利益平衡。第二部分论述了网络信息版权所有人集团的权利与实施。本章首先在讨论网络信息资源概念的基础上，划分出与版权有关的网络信息资源即网络作品，然后明确指出网络信息版权所有人权利扩张的内容，最后提出权利实施的三种措施。第三部分论述了网络服务商（即网络信息传播者集团）的权利与权利限制。在讨论了网络服务商的角色定位问题后，对不同类型网络服务商的权利与权利限制分别进行了讨论。第四部分论述了公众（即网络信息使用者集团）的权利与实施。讨论了在网络环境下公众权利的扩张以及在公众权利的实施过程中应该注意的三个问题。第五部分论述了利益重新平衡的两种手段，并在此基础上对网络信息版权制度的修订作一展望。更多还原

【Abstract】 AbstractThere are several social groups , whose interests are in conflict on internet information copyright. Ifs very important to define these social groups and analyze their relevant interests, because their attitudes towards coalition or separation on internet information copyright depend on their expectation to the copyright system. And as a result, it is necessary for us to analyze and reform copyright system.The thesis mainly applies analogy and inductive method to analyze the typical problems in relation to group interests of internet information copyright system, and seek interests balance again in internetThe thesis includes five chapters. The first discusses that the challenges on copyright system resulting from the internet. The internet technology has broken the interests balance of traditional copyright system, and many countries all over the world have adopt many important measures. This chapter introduces and evaluates some measures adopted by USA and EURO, and then presents a new opinion. The second discusses the rights of the copyright owner group and how to put them into practice. At first, the chapter discusses the conception of internet information resource, and then points out the specific contents of the copyright owners?rights, finally presents some measures. The third discusses the rights and duties of the internet service provider. The forth discusses the rights of the public and how to put them into practices. This chapter relates the rights expansion of the public in internet, and also asks for the public to adhere to some rules in internet. The fifth formulates two method to attain the interests balance again in the network space. And also suggests that how to revise the copyright system.更多还原
