【摘要】 近些年来,我国的食品安全问题不容乐观,从“染色馒头”到瘦肉精,从“地沟油”到“蒙牛涉癌门”再到部分洋快餐的“质量门”,众多的食品安全事件不断挑战公众心理承受,严重损害了公众的生命财产安全,扰乱了市场经济秩序的正常运转,对政府形象和公信力都是沉重的打击。今年的两会中,食品安全问题继续成为关注的热点。在这种情况下,重典治乱呼声高涨,刑法在食品安全治理中发挥更大作用就变得必要和可能。从立法层面织密食品安全刑罚网,完善打击食品安全犯罪的刑罚网络,细化明确食品安全违法犯罪的种类、罪名、罚则,使食品安全法律制度更加贴近实际、更具操作性是本文研究目的之所在。本文共分为四个部分。第一部分从食品安全犯罪基本内涵为切入点,分析食品安全犯罪构成,并对我国食品安全现状、问题进行简述,从而引出食品安全犯罪刑法保护的必要价值。第二部分对我国现有食品安全刑法历史沿革进行梳理,分析与评价《刑法修正案八》对食品安全刑事立法的修正,提出现行刑法中食品安全犯罪体系的主要缺陷。第三部分从域外视角(美国、日本)简单介绍对食品安全法律责任制度的规定,以期对其合理做法做吸纳与借鉴；第四部分针对现行刑法中食品安全犯罪体系的主要缺陷从违法犯罪的种类、罪名、刑罚体系、犯罪构成等方面提出立法完善建议,以更好的打击惩治犯罪。更多还原

【Abstract】 Study on legislative perfection of the crime of food safety in China.In recent years to, my of food security problem not optimistic, from "dyeing bread" to lean fine, from "ditch oil" to "mengniu involved cancer door" again to part Western fast food of "quality door", many of food security event constantly challenge public psychological bear, serious damage has public of life property security, disrupt has market economy order of normal running, on Government image and public letter force are is heavy of against. This year’s two sessions, food safety issues continue to be a hot spot of concern. In this case, Maxim governing voices rising, play a greater role in the criminal law in the food safety administration becomes necessary and possible.From woven network of key food safety penalties at the legislative level, perfecting the criminal penalties against food safety network, refine the type of clear food safety crimes, offences, penalties, make food safety legal system closer to the actual, more operational research purpose of this article is located. This article is divided into four parts. First cut from a criminal connotation of food safety and analysis on food safety crimes constitute, and brief them on China’s food security situation, problem, which leads to value needed criminal protection of food safety. Part two of our current food safety criminal history carding, analysis and assessment of the amendments to the Criminal Code of the eight amendment of criminal legislation for food safety, the existing food safety offences in the criminal law system of the major deficiencies.Part III from the perspective of outside (the United States, and Japan) briefly on the provisions of the liability system of food safety in order to absorb their reasonable practices and reference; part IV for existing food safety offences in the criminal law system of major deficiencies from the types of crimes, offences, the penalty system, the legislative perfection of the crime made recommendations in order to better combat crime.
