人本法律观视域下的基础教育法治建设

【摘要】 科学发展观的提出为中国的法治建设和法学研究提供了理论依据。人本法律观是科学发展观在法学领域的体现和应用,也是马克思主义法学中国化的重要成果。我们既要深刻理解认识人本法律观的理论价值,又要科学运用人本法律观来指导社会主义法治建设。人本法律观理论已经在立法、执法、司法等领域的法治实践中有所运用,但是在基础教育法治建设中的应用还缺乏研究,本文宗旨就是从人本法律观的视角提出加强基础教育法治建设的对策。文章主体内容分为以下三个部分:第一部分,从理论上阐述人本法律观这个马克思主义法学中国化的重要成果。拟从人本法律观的提出及其科学内涵、人本法律观提出的理论价值及其对基础教育法治建设的指导意义等内容进行阐述,意在为本文奠定理论基础。第二部分,介绍我国基础教育法治建设的现状。现状包括我国基础教育法治建设取得的成就和存在的问题。本文对基础教育法治建设的成就做了简要的总结,主要笔墨用于阐述基础教育法治建设面临的问题,使研究有针对性,有的放矢。第三部分,这是本文的重点部分,也是本文的价值所在,主旨是研究如何以人本法律观为指导加强我国基础教育法治建设。对此部分内容,阐述如下:首先,要树立以人为本的教育法治观。其次,在人本法律观指导下明确良法的制定标准,在立法过程中要求以人本法律观为指导。再次,教育行政执法法治建设的过程中需要由人本法律观为指导,完善教育执法体制。加强教育执法监督。另外,还要理顺基础教育法治建设中的师生法律关系,加强教师法律意识的培养。总之,本文是以人本法律观为视角,探讨人本法律观视域下的基础教育法治建设,研究人本法律观在我国基础教育法治建设中的指导地位以及人本法律观做为一种方法论对于基础教育法治建设实践的指导作用。

【Abstract】 Put forward the scientific development concept provides a theoretical basis for therule of law and legal studies. The important results of the legal concept is themanifestation and application of the scientific concept of development in the field oflaw, but also the Law of Marxism in China. We want a deep understanding of thetheoretical value of understanding the legal concept, but also scientific use of the legalconcept to guide the construction of socialist rule of law. The legal concept of theoryhas some use in the practice of the rule of law in the field of legislation, lawenforcement, judicial, but also a lack of research in the construction of basic educationand the rule of law, this article aim is to strengthen basic education from the perspectiveof the legal concept The countermeasures of the rule of law.The articles main content is divided into the following three parts:The first part, explained theoretically important outcome of the legal concept ofMarxist law in China. Intends to elaborate raised its scientific connotation of the legalconcept, the legal concept of theoretical value and its guiding significance for theconstruction of basic education and the rule of law, is intended to lay the theoreticalfoundation for this article.The second part describes the construction of the status quo of China’s basiceducation and the rule of law. The status quo, including the construction of basiceducation and the rule of law in China’s achievements and the problems. Brief summaryof the achievements of the construction of basic education and the rule of law, the mainink used to illustrate the problems faced by the construction of basic education and therule of law, so that research targeted, targeted. The third part, which is the focus of thisarticle, but also the value of this article, the purpose is to study how to strengthen basic education in China rule of law as a guide to the legal concept. This part of the contents,are described as follows: First, the concept of people-oriented education should fosterthe rule of law. Second, the legal concept under the guidance of a clear formulation ofstandards for good law, in the legislative process requires the guidance of the concept ofthe law. Again, the process of education construction of administrative law enforcementand the rule of law, the legal concept as a guide to improve the education lawenforcement system. Strengthen the education of law enforcement supervision. Also, tostraighten out the legal relationship of teachers and students in the construction of basiceducation and the rule of law, strengthen the cultivation of teachers’ awareness of thelaw.In short, we adhere to the guidance of Marxism and the scientific concept ofdevelopment, the legal concept perspective to investigate the construction of basiceducation and the rule of law under the legal concept of sight, study the legal concept ofthe rule of law in China’s basic education guidance status and the legal concept as theguiding role of a methodology for the construction practice of basic education and therule of law.e.
