【摘要】 随着我国城镇化进程的加快，城镇建设用地需求量的不断增加，使得运用土地征收方式将农村集体土地转变为城市建设用地的规模和力度越来越大。目前在农村集体土地征地补偿费分配过程中，仍然存在乡村截留、分配对象不确定、集体组织成员内部分配不公平等一系列的问题，引致了许多征地补偿纠纷，严重损害了农村集体经济组织的利益和被征地农民的土地权益，不仅影响了我国农村社会的稳定和农村经济的发展，而且也阻碍了我国土地征收工作的顺利开展。本文基于集体组织成员的视角，选择不同类型的征地补偿纠纷案例，在对UNDP课题组实地调研数据和笔者访谈记录整理的基础上，结合成员权理论和交易费用理论，运用PSA法和MECE原则，对征地补偿费分配过程中存在的问题进行分析。主要得出以下结论：1．由于集体组织成员资格的界定困难，导致在征地补偿费分配过程中出现分配对象不明确。因此，要进一步明确征地补偿费的分配对象。2.由于集体组织成员之间的权利量不清，导致征地补偿费在集体组织成员内部分配不公平。因此，要进一步明确征地补偿费的分配方式。3.造成征地补偿费用内部分配规则不清的一个根本原因在于人地依附关系紧密的户籍制度和集体土地产权制度无法适应社会主义市场经济发展的要求。因此，需对我国人地依附的农村集体土地产权制度进行根本性的变革。更多还原

【Abstract】 With the accelerated urbanization process in China, the demand for constructionland is increasing，lead to the size of rural collective land which occupied by the way ofland expropriation is increasing. At present in the process of land expropriationcompensation fee allocation of rural collective land, there are still a series of problems,such as rural interception, object allocation uncertain, collective member’s internalunfair distribution and so on, which caused many land expropriation compensationdisputes, serious damage to the interests of the rural collective economic organizationsand the land rights and interests of the farmers whose land has been expropriated. Notonly affects the development of our country’s social stability in rural areas and the ruraleconomy, but also hinder China’s land expropriation work smoothly.This paper based on the perspective of the members of collective organization,choosing different types of land expropriation compensation dispute case, based on theUNDP research group’s survey data and the interview record of the author, withmembers of the right theory and transaction cost theory, by using the PSA method andthe MECE principle, carry on the analysis of the problems in the distribution of landcompensation process.Mainly draws following several conclusions：1. Because of the difficulties in defining the membership of collective organization,resulting in the allocation of land compensation of distribution objects are not clear.Therefore, we need to further clarify the distribution objects of land expropriationcompensation fee.2. Because the right amount between the collective members of the organization are not clear, leading to the compensation for land expropriation in the collectivemembers of the internal organization of unfair distribution. Therefore, we need tofurther clarify the distribution modes of land expropriation compensation fee.3. A fundamental cause of internal distribution rules of land compensation fees isthat the household registration system and the collective land property right system cannot adapt to the requirements of the socialist market economy.
