【摘要】 集资诈骗罪、非法吸收公众存款罪等非法集资的犯罪行为不仅严重破坏国家对金融秩序的管理制度,还损害社会公众尤其是出资人的利益。本文以“吴英非法集资案”这一经典案例为分析材料,运用刑法学相关理论,对有关法律问题进行探析,重新审视案件的争议点和法院判决,希望为集资诈骗罪、非法吸收公众存款罪在司法实践上的认定提供参考。最后,阐述由吴英案所引发的一些思考和立法完善建议。本文主要从以下三部分进行论述：第一部分主要介绍了吴英非法集资案的基本案情、控辩双方的观点及争议点、法院对争议点的认定与判决。第二部分是本文的重点。笔者对吴英案中所涉及的几个相关法律问题进行分析,在此基础上对案件中的争议点和法院的判决运用刑法学相关原理进行重新审视,并据此得出新的结论。第三部分是笔者在评析吴英非法集资案过程中所产生的一些思考,如,集资诈骗罪作为经济犯罪中保留死刑的制度是否合理……最后,笔者对我国刑法在打击非法集资犯罪方面的立法完善建议。更多还原

【Abstract】 The crime of illegal fund-raising, such as crime of fund-raising fraud, illegal absorbing public deposits etc, not only destroies the management system of the state on financial order, but also damages interests of the general public, especially for investors. By using the theories of criminal law bases on the classic case "Wu Ying illegal fund-raising case", we analyze the relative legal issues and re-examine the disputes and the judgment of the court,which provides a reference for the identifying of the crime of fraud and crime of illegal absorbing public deposits on judicial practice. Finally, stating some thoughts and suggestions on the legislative perfection, which are caused by the Wu Ying case.This paper mainly discusses the following three parts:Mainly introducing the details of Wu Ying illegal fund-raising, the views and controversial points of both sides, the cognizance and judgment of court on disputed points, in the first part.The second part is the focus of this article. Basing on analyzing several related legal issues are involved in Wu Ying case, We re-examines the disputes in the case and the judgment of the court by using the related theories of criminal law and then get a new conclusionThe third part is some thoughts are emerged by analyzing the process of the illegal fund-raising case for Wu Ying.For example, as economic crimes, whether retaining the death penalty system is reasonable in crime of fund-raising fraud......Finally, We give advices on China’criminal law cracks down on crime of illegal fund-raising.更多还原
