【摘要】 近年来，被执行人利用法律漏洞或采取不正当手段规避执行的现象日益突出，这已成为影响我国司法公正及司法公信力的一大问题。2011年5月27日，最高人民法院颁布了《最高人民法院关于依法制裁规避执行行为的若干意见》，将当前大量被执行人规避执行的不良现象作为工作重点强力推进，各级法院也纷纷响应，加大了执行工作力度。但是随着被执行人采取的规避执行手段日趋多元化和隐蔽化，再加上相关法律法规不健全、工作措施不到位等原因，导致规避执行现象屡禁不止，这不仅损害了债权人的合法利益，影响了执行工作的顺利开展，而且破坏了良好的社会经济秩序。这就需要我们认真研究总结，采取切实有效措施，不断完善相关制度，彻底遏制、打击规避执行行为，实现执行工作的新发展。本文综观规避执行的诸多表现，从理论上抽象出规避执行行为的特征、责任性质及表现样态，从源头上分析规避执行行为的成因与危害，再立足于我国规避执行行为规制的困境，结合法院执行工作的实践，进而重点探讨规避执行的反制规制的构建，以期能够严厉打击规避执行行为，提高执行工作的质量和效率，最大限度保护当事人的合法权益。更多还原

【Abstract】 In recent years, the phenomenon of person subjected to execution using legalloopholes or taking unfair measures to avoid execution is increasingly prominent, and ithas become a big problem of influencing the judicial justice and judicial credibility of ourcountry. On May27,2011, the Supreme People’s Court promulgated several opinionsabout avoiding execution behavior in accordance with the law sanctions, taking thephenomenon of a large number of the person subjected to execution to avoid execution asthe focus of work. All levels of courts have to response to increase the intensity of theexecution. However, there’re some reasons lead to the phenomenon of avoiding executionunprohibition, such as the measures of the person subjected to execution to avoid executionare more diversified and concealed, inadequate laws and regulations, the lack of workmeasures. It not only damages to the legitimate interests of the creditors and influences thecourts work smoothly, but also destroies the good social and economic order. For curbingand blowing of avoiding executionIt completely and achieving the new development ofexecution, it requires us to study and conclud seriously, take effective measures and perfectthe relevant systems constantly.This article throughouts the many performances of avoiding execution. It abstracts thecharacteristics, responsibilities, performances, reasons and damages of avoiding execution.Based on the difficulties of our country to take measures of avoiding execution and thepractice of the courts execution work, this article focuses on the construction of countermeasures of avoiding execution.
