【摘要】 近年来，随着影响全国的孙伟铭案、三鹿奶粉案1等一系列以危险方法危害公共安全罪案件的审理与宣判，理论界与实务界之间针对该罪的相关问题展开了热议，其争议的焦点集中于此罪与彼罪的认定上，但该罪的刑罚适用问题却被忽视。在十一届全国人大五次会议上，“尊重和保障人权”被写入刑事诉讼法,人权观念也不断深入人心。刑罚适用是否恰当直接关系到被害人和被告人的权益能否得实现，因此，刑罚的适用问题将得到人们更加广泛的关注。本文共分为三个部分，第一部分对以危险方法危害公共安全罪法定刑配置及其依据进行了解析；第二部分分析目前我国司法实践中关于该罪的刑罚适用所产生的问题；最后一部分提出解决这些问题的相关建议,以此进一步完善我国以危险方法危害公共安全罪的刑事处罚，契合刑法罪责刑相适应原则，更好地体现刑法的人权保障精神和价值，落实宽严相济的刑事政策。更多还原

【Abstract】 Recent years, with a series of universal impact cases, like “Sun Weiming” case and“Sanlu milk power” case2，have been sentenced to the crime against public security bydangerous means. There are many hot discussions about the revolving problems, betweenthe theorists and the practitioners. And the controversies focus on which one crime it is.However, the applicability of the penalty has been ignored. As people’s rights awarenesscontinues to strengthen, more and more people concerts the importance of the human rights.On the fifth session of the11th National People’s Congress,"respecting and protectinghuman rights" is written to Criminal Procedure Law. And whether the application of crimeis appropriate has a direct relationship with the defendants and the victims’ rights. Thepenalty applicable to the crime against public security by dangerous means will get muchmore attention.The article is divided into three parts. The first part analyzes the statutory sentenceconfiguration and grounds of the crime against public security by dangerous means. Thispart explants in detail the revolving authorities. The second part analyzes the problems thatoccurred in process of the application. The last part proposes some advice about thoseproblems, in order to further improve the crime’s punishment system. These coincide withthe principles of criminal law, and to better reflect the spirit of the age and value of thecriminal law. All of this is to implement the policy of combining punishment with leniencypenalty.更多还原
