【摘要】 屡禁不止的“黑诊所”已经成为我国社会的一个顽疾。黑诊所不但扰乱了我国医疗市场的正常秩序,而且对人民群众(尤其是贫困群体)的生命健康造成了严重威胁。如何根除黑诊所是目前我们面临的严峻问题。本文在阐明黑诊所存在现状及危害的基础上,进一步从立法、执法和司法三个层面对黑诊所屡禁不止的原因进行了分析,进而对如何有效整治黑诊所提出了法律建议。具体而言,本文主要分为以下三个部分：第一部分,黑诊所存在现状及危害。黑诊所在我国的存在呈现出一定的地域性、隐蔽性以及反复性特征。它不但扰乱了我国医疗市场的正常秩序,导致部分地区出生人口性别比例失衡,而且对人民群众(尤其是贫困群体)的生命健康造成了严重威胁。第二部分,黑诊所屡禁不止的原因分析。该部分主要从立法、执法和司法三个层面进行了分析。从立法上看,我国行政法和刑法中关于禁止“非法行医”的规定是打击黑诊所的主要依据,但这些法律依据之间存在着一定的矛盾,削弱了司法实践中打击黑诊所的力度；从执法上看,黑诊所的“抗检力”不断增强,增加了执法难度,执法监管机制不完善,降低了执法效率；从司法上看,我国打击非法行医的“行刑衔接”工作机制尚不成熟,“以罚代刑”的情况时有发生,无法有效整治黑诊所。第三部分,整治对策。有效整治黑诊所,完善相关法律法规十分关键,加快建立“举报制度”与“黑名单制度”,完善卫生执法监管机制,加强各部门联合执法与健全行刑衔接工作机制也刻不容缓。更多还原

【Abstract】 The phenomenon that illegal clinics still survive has been a kind of "chronic disease" in China. They not only disturb the order of our country’s medical and care market, but also become a big threat to people’s health, especially to the poor. How to eradicate the illegal clinics is a challengeable issue we are confronted with. This paper has made an explanation of the present situation and causes of illegal clinics and an analysis of causes from the perspectives of legislation, law enforcement and judicial practice. Finally, it has proposed some countermeasures.Firstly, black clinic’s present situation and harm. Regional character, concealment and repeated characteristics are the critical situations of black clinics in China. It not only disrupts the normal order of the medical market in China, which results in population imbalance in the sex ratio of birth partly, but also poses a serious threat to the health of life, especially for the poor.Secondly,the reasons for black clinic’s repeated bans without effects. The main legislative, law enforcement and judicial analysis are conducted at three levels. From the legislation point of view, administrative law and criminal law in China on the prohibition of the "illegal practice" requirement is the main basis for cracking down on illegal clinics, but there is a certain contradiction among the legal basis, which has weakened the judicial practice of cracking down on illegal clinics in intensity; From a law enforcement point of view, the black clinics "resistance forces seized" increases the difficulty of law enforcement. Law enforcement supervision mechanism is not perfect, reducing the efficiency of law enforcement; From the judicial point of view, the illegal practice of "death squads" convergence "mechanisms are not yet mature," to punish torture " happens frequently and black clinics cannot effectively be harnessed.Thirdly, tackling measures. Effective treatments of black clinics, improving relevant laws and regulations are critical to accelerate the establishment of "reporting system" and "blacklist system". Perfecting health law enforcement and supervision mechanism, strengthening joint law enforcement and perfecting convergence of mechanisms of execution are also pressing tasks.更多还原
