【摘要】 随着社会的进步和经济的发展,建国初期形成的的监企合一制度已经不能发挥其在计划经济下的优势。2003年,监狱体制改革拉开帷幕。经过两批试点尝试之后,2008年国务院批准司法部决定在全国推开监狱体制改革。2012年监狱体制改革任务已基本完成。山东省监狱企业改革的实质是对政企分开的落实与深化。通过对山东省监狱企业改革过程进行研究,揭示监狱企业不同于一般企业的特点,记录山东省监狱企业改革对监狱发展带来的影响,并分析山东省监狱企业改革存在的问题,寻求深化改革的措施。监狱体制改革全国推开以后,监狱企业作为独立法人存在,但由于目前监狱经费保障不能完全到位,监狱企业还有为罪犯改造提供劳动场所的职责,业务方面的联系还很多,短时期监狱与监狱企业无法彻底分离。监狱企业改革并未完全解决监狱企业责任不明、企业发展受劳动力限制、人事改革难等各个方面的问题,而且.在监狱企业改革过程中地方政府与监狱系统的利益冲突更加激烈、监狱企业机构设置不合理造成的影响更加突出。调查山东省部分监狱企业改革过程中组织结构、产业结构的调整,可得出如下结论：监狱体制改革在山东省监狱系统得到很好的落实,伴随着监狱体制改革进行的监企分开进展顺利,但并未达到预期的目标。监企分开的举措只能在一定程度上能缓解却不能从根本上解决监狱体制存在的问题,必须对监狱企业进行非营利性改造才有可能实现监狱体制改革预期目标。监狱企业的组织形式、劳动力构成、产业结构方面的先天不足势必导致其对监狱的依赖性。监狱在运行经费得不到全额保障的情况下直接将监狱企业完全剥离也不利于监狱和企业的发展。只有进行非营利性的监狱生产才能从根源上解决监狱体制存在的问题,但是目前监狱运行经费缺口较大,仅靠有限的财政保障还不能保证监狱的正常运行,监狱企业作为监狱生产营利到非营利的过渡必然需要存在一定时期。综合调查与研究的结论,本文针对山东省监狱企业改革存在的问题提出四条深化改革的措施：一是监狱系统实行垂直管理,明确监狱企业首要责任；二是山东省监狱企业改革应该采取有差别的渐进的方式；三是建立高效的监狱企业管理机构,使监狱企业逐步向非营利方向运行；四是全面建立罪犯劳动报酬制度并充分发挥其作用。更多还原

【Abstract】 With social progress and economic development, the prison and enterprise combination system which formatted in the initial can not play its advantage under the planned economy. In2003, the prison system reform pulled open heavy curtain. After several experiments, in2008the State Council approved the Ministry of justice decided in the national start the prison system reform. The task of prison system reform in2012has been basically completed. Because the relationship between prison and prison enterprise interdependent, prison enterprise reform with respect to the prison system reform progress slightly delay.This paper attempts to study the process and results of the reform of prison enterprises in Shandong Province, revealed the characteristics of the prison enterprise is different from general enterprises, and analyses the prison enterprise reform unresolved and new problems. After the national prison system reform open, the prison enterprise exists as a separate legal entity, but the prisons and prison enterprises segmentation is not thorough, prison enterprises and provide labor place for criminals responsibility, business contacts also many. Prison enterprise reform does not completely solve the prison enterprise responsibility is unknown, enterprises by the labour restrictions, personnel reform more difficult problems. And in the process of the prison enterprise reform in the interests of the game between local government and the prison system, prison enterprises more intense influence caused by unreasonable more prominent.In the investigation of Shandong province part of the prison enterprise organizational structure, human resources, industrial structure, draws the following conclusion:the prison system reform well implemented in the prison system in Shandong Province, accompanied by the prison enterprise reform of prison system reform has made great achievements but did not achieve the desired objectives. Separation of enterprise from prison measures only can alleviate cannot solve the prison system existing problem fundamentally in a certain extent, must carry on the transformation of the prison enterprise profit can be achieved in the prison system reform target. Prison enterprise organization form, labor structure, the industrial structure is bound to lead to be congenitally deficient prison dependence. The prison in the operating funds are not full security situation directly to the prison enterprise completely stripping is not conducive to the development of its own. The prison production to non-profit solve prison system existing problems from the root, but the gap larger prison funds, rely on finance security finance limited also can not guarantee the normal operation of the prison, the prison enterprises as profit to transition the non-profit inevitably requires the presence of certain period.Conclusion investigation and study, puts forward reform measures aiming at the existed in the reform of prison enterprises in Shandong province of the problem:Firstly, establish the vertical management of the prison system, clear the primary responsibility of prison enterprises; Secondly,the reform of prison enterprises in Shandong province should take different gradual way; Thirdly, is the establishment of the prison enterprise management mechanism of high efficiency the prison enterprises, gradually to nonprofit direction; Fourthly,establish a comprehensive system of labor remuneration offenders and fully play its role.更多还原
