【摘要】 随着我国经济的飞速发展,我国市场主体的数量大幅增加,各类市场行为也日益活跃。面对新形势和出现的新问题,作为维护市场经济秩序的行政机关,工商行政管理部门肩负的责任更加重大。同时,随着依法行政理论的不断深入人心,行政相对人的维权意识、行政监察及监督力量的日益增强,对工商行政执法水平和执法质量的要求也越来越高。震惊全国的阜阳奶粉、苏丹红、瘦肉精、三鹿奶粉、农夫山泉等事件,使很多工商干部因执法不作为、监管不严、执法不当等受到问责和追责,也为我们敲响了防范行政执法风险的警钟。2007年,国家工商总局开始推行风险点管理,2009年初,又在推行廉政风险点防范管理的基础上开展防范监管风险活动,工商机关行政执法风险防范理论得到进一步的充实和扩展。行政执法是工商行政管理机关建立和维护市场经济秩序的基本手段,加强对行政执法风险的防范,减少和规避执法风险,才能有效维护国家利益和人民群众生命财产安全。因此,为了进一步提高工商行政管理机关行政执法水平,规避和预防执法风险的发生,更好地维护国家经济秩序,促进经济发展,我们必须要深入研究好如何防范工商行政执法风险。本文运用调查研究、文献研究、理论与实践相结合的研究方法,通过查阅各种专业文献,整理归纳国内外研究成果,结合自身工作实际和所学的公共管理理论,从潍坊市工商系统行政执法风险防范的现状、存在的问题入手,分析工商部门行政执法风险形成的原因,提出防范工商行政执法风险的对策和建议。更多还原

【Abstract】 With the rapid development of China’s economy, China’s markets are increaseing rapidly, behavior of all kinds of markets are also increasingly active. In face of the new situation and new problems, in order to maintaine economic order of markets, the administrative department for industry and commerce should shoulder more responsibilities.At the same time, along with the deepening of the theory of administration, the raise of the consciousness of administrative relative person’s rights, administrative supervision onrindustry and commerce are increasing, the administrative law enforcement level and the requirements of the law enforcement quality should improve more quickly. Much of events shocked around the country including in the milk powder of Fuyang, Sudan red, lean meat powder, milk powder of sanlu milk powder, nongfu spring and other events a lot of carders of industry and commerce shoulder law responsibilities because of improper accountability which also ring an alarm for us, since2007State administration for industry and commerce began to implement risk management. In2009,and on the basis of integrity risk point guard management to carry out activities against regulatory risk,Organs of industry and commerce administrative enforcement of law risk prevention theory further enrich and extend.The administrative law enforcement is the basic means of administrative department for industry and commerce to establish and maintain the market economic order, to prevent the risk of administrative law enforcement, reduce and avoid the risk of law enforcement, can effectively protect the interests of the state and people’s life and property safety. Therefore, in order to further improve the administrative law enforcement level of administrative department for industry and commerce, and avoid the occurrence of risk prevention law enforcement, and to better safeguard national economic order, and to promote economic development, we have to further study how to prevent the risk of enforcement of administration for industry and commerce.In this paper, the writer use the methods of research, literature research, combining theory with practice research and get access to all kinds of professional literature, summarize the domestic and international research results, put my own practical work into practice and learn from public management theory, from the status and problems of law enforcement risk prevention for industry and commerce system of administrative in weifang city, and analyzes the causes of the formation of the risk, and puts forward the prevention of industry and commerce administration law enforcement risk countermeasures and Suggestions.更多还原
