【摘要】 国家的政策支持和资金倾斜使具有资源优势的新疆成为经济发展的的热点区域。跨越式发展可能带来污染物排放量激增的环境问题，使新疆原本脆弱的生态环境面临更加严峻的考验。虽然环保优先和生态立区的发展理念和核心思想被确定为新疆环境保护地方立法的原则，但是新疆的生态补偿主要以政策的形式存在环境保护工作中，其部门色彩的强烈、延续性差和补偿组织管理混乱，阻碍了新疆生态补偿的实施，影响了新疆生态环境的保护和恢复。为此，我们需要通过法律的手段规范和完善新疆的生态补偿制度，使之在法律的框架内解决缺少法律统一指导、生态补偿相关内容界定不明确等问题。通过分析新疆生态环境形势、生态补偿的立法现状及其不足，本文提出从加强新疆生态补偿立法和配套生态补偿相关制度两方面完善新疆生态补偿法律制度，希望对新疆生态环境保护和恢复提供有益帮助。更多还原

【Abstract】 Xinjiang having great-leap-forward development advantages in natural resourcesand gaining the fund incline that country priority invests in becomes the hot spot ofthe rapid development of the economy of the area. Great-leap-forward deploymentmay bring the environmental problem that pollutants emission increases sharply. Andthe fragile ecological environment of Xinjiang is faced with more severe tests.Although Environmental priority and Ecological made area of the developmentphilosophy and core ideas are identified as the Xinxiang environmental protectionprinciple of local legislation, the ecological compensation in Xinxiang mainly in theform of policy has intense color of department﹑weak continuity and chaos of theorganization management. So it is difficult to carry out the ecological compensationof Xinjiang and to recover the ecological environment. Therefore, we need the meansof the law to regulate and improve the ecological compensation system of Xinxiang,in order to solve the problems that ecological compensation of Xinxiang lacked theunified guidance of law and content of the ecological compensation is not clearlydefined. Through the analysis of the ecological environment situation in Xinjiang、thepresent situation of ecological compensation in Xinxiang legislation and itsshortcomings, this paper puts forward through strengthening Xinjiang legislation andsupporting ecological compensation related systems to perfect the ecologicalcompensation legal system of Xinjiang. And it is helpful to the ecologicalenvironment protection and restoration in Xinjiang.更多还原
