食品配方的知识产权保护模式研究

【摘要】 经过数十年的发展,我国食品配方的知识产权保护逐渐形成了商业秘密保护以及专利法保护的“二元”保护模式。然而,正是这一“二元”保护模式却带了许多现实的弊端,影响了消费者知情权的实现,影响了人们生命健康权的实现,一定程度上还影响了我国食品安全环境。与此同时,这一模式也存在一些矛盾和冲突。这一矛盾和冲突在法学理论上集中的体现为食品配方的商业秘密保护与消费者知情权的冲突。如何解决现实中存在的“二元”保护模式的弊端;如何解决消费者知情权与食品配方所有者的权利冲突问题,如何实现消费者的知情权与经营者食品配方合法利益的协调和发展是本文思维的主线,论述的重点。本文将从食品配方的基本概念出发,借鉴域外关于食品配方知识产权保护的立法选择及成功经验,直面我国食品配方知识产权“二元”保护模式的弊端,剖析弊端下所隐含的法益冲突,通过权利冲突理论的分析以确立食品配方的“一元”保护模式。虽然这一“一元”保护模式并不是绝对的,但却都是在保证消费者知情权的前提下展开的设计。希冀以此促进我国食品安全环境的好转的同时保障经营者的合法权益。

【Abstract】 After years of development, the intellectual property of food formula in our country is now protected as a kind of both commercial secret and patent, forming a dual-protection mode. However, under such a mode, some disadvantages do exist in practice as well as the mode itself has several conflicts and inconsistencies, among which on the aspect of legal theory the conflict between the protection of food formula as a kind of commercial secret and consumers’rights of being in the know is the most irreconcilable one. How to overcome the disadvantages incurred by the dual-protection mode in practice? How to settle the conflict between the protection of food formula as a kind of commercial secret and consumers’rights of being in the know? How to coordinate the consumers’rights of being in the know and the dealers’ right of commercial confidential? These questions, as clues of the paper, will be expounded below.Based on the basic concept of food formula, the paper will draw lessons from foreign countries on legislations on the intellectual property and learn some successful experiences from them. It will directly point out the disadvantages brought by the dual-protection mode in our country in order to expose and analyze the law interests thereunder. According to the analysis on conflict theory on rights, it advocates single-protection mode on food formula.Although,the single-protection is nor absolute open to the people.But all this ideas is so as to improve the situation of food security in our country
