【摘要】 我国的煤炭储量居世界第一。煤炭在我国的社会生产中占有重要地位。煤炭是我国经济前进的动力，处于经济快速发展的中国正是处于煤炭资源的高需求阶段。而与煤炭高需求，高产量相伴而生的是我国日益突出的煤炭生产安全的问题。如何能在保证安全生产的前提下，保障煤炭的产量是我国现阶段所面临的重要课题。随着时代的进步，强调人本主义已经是时代的潮流。煤炭工人的安全已经是全社会、全世界所关注的焦点。一些先进国家早已将以人为本的思想融入法律之中，一切以保障矿工的生命健康为前提。而在我国，虽然一再强调安全的重要性，但是由于基本是从企业和经济的角度出发，缺少对人本身的关注，使得矿工的生命与健康得不到最完善的保护。与先进国家相比，我国在科技投入、安全设备和煤炭企业制度都有差距，但最为重要的是我国煤炭安全法律的完善。如何将我国的煤炭安全法律与科学发展观结合起来，真正做到以人为本，只有这样才能将安全落到实处。本文借鉴国外煤炭生产安全的先进经验，保障煤炭生产工人的生产安全，探讨如何在科学发展观的指导下，以人为本,建立一套科学、完善的煤炭安全生产法律体系，保证我国煤炭生产的安全和国家经济社会的和谐发展。本文首先介绍我国煤炭安全的时代背景，阐述我国煤炭安全生产现状，分析了我国在煤炭安全生产中的问题，总结出自然环境因素、落后的设备和生产技术原因和企业管理制度的缺陷。在煤炭安全法律方面，回顾了我国煤炭安全发展的历史，分析了我国的立法现状、执法现状以及现存的一些法律问题。对比先进国家，美国、德国和智利的先进经验，通过分析中国王家岭矿难和智利矿难的对比，完善我国的煤炭安全法律制度。更多还原

【Abstract】 China’s coal reserves ranking first in the world. Coal in China occupies an important position insocial production. Coal is our country economy forward momentum, in the rapid economicdevelopment of China is at the stage of high demand of coal resources. While coal and high demand,high yield of concomitant is our country is increasingly outstanding coal production safetyproblems. How to ensure safety in production under the premise of ensuring coal production, atpresent China is facing the important subject.With the progress of the times, emphasize humanism is the trend of the times. Coal workers’safety is the whole society, the whole world’s attention. Some advanced countries already will bepeople-oriented ideas into law, all in order to protect miners’ life and health as the premise. But inour country, although has repeatedly stressed the importance of safety, but because only fromenterprise and economic point of view, the lack of people ’s own concerns, the miner’s life andhealth is the most perfect protection. Compared with advanced countries, our country in science andtechnology investment, safety equipment and coal enterprise system has difference, but the mostimportant is our country coal mine safety law. How China’s coal mine safety law and scientificoutlook on development together, truly people-oriented in order to implement the security.The article draws lessons from foreign advanced experience of coal production safety, ensure thesafety production of coal production workers, to explore how the scientific outlook on developmentguidance, people-oriented, set up a set of scientific, perfect legal system to ensure the safety inproduction of coal, China’s coal production safety and the national economy the harmoniousdevelopment of society.This paper first introduces the background of our country coal mine safety, elaborated ourcountry coal mine safety production present situation, has analyzed our country to coal mine safetyproduction problems, summed up the factors of natural environment, backward equipment andproduction technology and enterprise management system defects. In the coal mine safety law,reviewed our country coal safety in the history of the development, analysis of China’s currentlegislation, enforcement situation and the existing problems. In contrast, the United States advancedcountries, Germany and Chile’s advanced experience, through the analysis of Chinese Wangjialingmine and mine contrast, perfecting the legal system of coal mine safety.更多还原
