【摘要】 在长期计划经济体制下,我国已形成了管制型政府、审批型政府、高成本政府,急需转变政府职能,建设服务型政府。在这个大框架下,工商行政管理部门作为国家主管市场监管和行政执法的职能部门,应遵循社会主义市场经济运行规律,不断推进工作机制和管理方式改革,建设高效、廉洁的“服务型工商”。工商部门是执法、管制特征最鲜明的政府部门之一,解决服务型政府建设问题将产生很大的示范作用。工商行政管理所处于监管执法的最前沿,是工商行政管理行政执法主体的重要组成部分和延伸,是工商队伍的基础。长期的管制型政府部门运营模式使工商行政管理所的执政理念、工作目标、工作程序和方法等都不能适应新市场经济时代的服务要求。特别是现阶段停止征收“两费”带来了巨大的挑战,工商所要尽快完成从“收费型工商”向“服务监管型工商”的职能转变,必须不断改革、不断建设、不断完善。本文以云南省工商系统为例,结合现阶段停止征收“两费”的实际,围绕工商所开展基层建设的必要性、目标和工作任务将对基层工商所职能转型的研究引向深入,并为各级政府进行相关研究决策时提供理论和实践意义上的参考。对于现阶段如何加强我省工商所基层建设,本文认为：要加强职能建设,适度调整现有基层工商所布局,充实基层执法力量,合理设置工商所内部机构,逐步下放监管执法权限；要加强制度建设,完善工作机制,建立健全工作规范和流程,规范执法行为,创新监管方式；要加强服务能力建设,提高服务效能；要加强信息化建设,提升现代化操作技能；要加强队伍建设,开展大教育、大培训、大练兵,培育复合型人才；要加强精神文明建设,搞好工商文化建设；要加强基础设施建设,整合执法装备、经费、用房等资源。更多还原

【Abstract】 Due to the impact from the long-term planned economic system, Chinese government has become a control-oriented and approval-oriented institute with a huge expenditure, which calls for transforming government functions and building a service-oriented government. Under this framework, as a national department to enforce market regulations and administrative laws, the Administration for Industry and Commerce should follow the law of the socialist market economy, continually push forward the reform of the working mechanism and management, and construct itself into an efficient, honest and service-oriented department. Administration for Industry and Commerce is one of the key departments in enforcing laws and regulations, and its service-oriented transformation will be a great example.Office of Administration for Industry and Commerce at basic level is the front line in enforcing laws and regulations. Long-term control-oriented operational mode of government departments has disabled Administration for Industry and Commerce meet service requirements of the novel market economy in terms of governance concept, working objectives, procedures and methods. Particularly, after suspending the collection of the "two fees"(individual business management fee and trade market management fee), Office of Administration for Industry and Commerce at basic level have to face enormous challenges; consequently, it has to carry out reform, transform from charge-oriented to service-oriented. Functioning as the window, Office of Administration for Industry and Commerce at the basic level is not only the vital part and extension of main administrative bodies in industrial and commercial administration, but also the base for related departments in industry and commerce. Taking Administration for Industry and Commerce in Yunnan Province as a case and reckoning with the need, objectives and tasks in constructing administrative bodies, this paper explores the significance brought out by such construction to the functional transformation of administrative bodies for industry and commerce at the grass-root level system, and provides some theoretical and practical reference to government at all levels in their decision-making.This paper sheds some light on strengthening the construction of Office of Administration for Industry and Commerce at the basic level:to strengthen the function-building of this department, appropriately adjust its existing layout, beef up law enforcement forces at the grass-root level, reasonably set up inner departments within it, and gradually delegate regulatory enforcement authority; to attach more attention to the system construction, improve the working mechanism, establish and improve working practices and procedures, standardize law enforcement activities and innovate supervision and regulation; to enhance service capability and improve service performance; to put more efforts in information technology development and enhance the operational skills; to enlarge the size of staffs, carry out large-scale education, training and exercise, and foster versatile talents; to reinforce the building of spiritual civilization, improve the construction of business culture; and to redouble efforts in constructing the infrastructure and integrating such resources as law enforcement equipment, funds and working space.更多还原
