【摘要】 对于农民权的保护不仅仅是一般意义上的权利保障问题,而且是法学的根本任务所在。在法学领域,对农民权的保护既是法律平等原则最基本的体现,也是我国宪法的内在要求。本文通过研究和分析在地理标志保护中如何实现农民权,使得农民权既充分的体现在法学尤其是经济法研究领域内,也使得农民权贯穿于地理标志保护的各个环节中。本文将以经济法的原理与利益机制为视角,探寻关于经济法和农民权保护的结合点,寻找经济法保护农民权的理论基础和原则,提出在经济法视野下保护农民权的合理机制。本文在对知识产权和经济法巧妙结合的过程中,凸显农民权在地理标志保护中的重要地位。无论国际还是国内都没有赋予农民在地理标志保护中的权利,专家学者不乏对农民权的研究,也不乏对地理标志保护的研究,而对这两者之间关系的研究很鲜见。本文将对涉及地理标志保护中的农民权的保护模式和实现形式进行分析比较,从而得出如何更好的在地理标志保护中最大限度的实现农民权。本文中作者运用了比较分析和实证分析的方法,就地理标志保护中的农民权问题进行了研究,并提出了具体的解决对策。本文除引言和结论外,共分为五部分。第一部分简单介绍国际通行的地理标志的基本概念以及保护模式,总结分析我国地理标志的保护模式。第二部分探寻法学领域重点是宪法学和经济法学当中对农民权保护的依据和原则,并揭示经济法学、知识产权以及农民权之间的内在联系,找到三者之间的契合点,通过分析得出三者相互依存的关系。第三部分通过对国外地理标志保护以及植物新品种保护中农民权问题的列举和分析,总结出其他国家在农民权保护方面的先进经验,以供我们学习和借鉴。第四部分和第五部分主要对中国地理标志保护当中的农民权问题进行了剖析和提炼,指出其应然权利和实然权利存在的差距,并在此基础上笔者提出了解决方法和对策。总而言之,对地理标志的保护是一场持久战,也需要法学各个部门的通力合作。而认识到农民权在地理标志保护中重要作用和地位将是赢得这场战争的首要条件。本文着重从经济法和知识产权法视野下分析我国对地理标志保护中的农民权,揭示出其保护力度的不足以及不足的根本原因。通过对比比较分析国内外在地理标志保护中如何实现农民权,总结提出在地理标志保护中实现农民权的对策和方法。更多还原

【Abstract】 Protection of farmers’rights is not only an issue of right security and safeguard in the ordinary sense, but also is the fundamental task of jurisprudence. In law realm, protection of farmers’rights is the most basic embodiment of the principle of legal equality, also is the inherent requirement of our Constitution. This article through research and analysis how to realize farmers’rights in protection Geographical Indications, make the farmers’rights be embodied in jurisprudence, especially in Economic Law study realm, make the farmers’rights be respected and protected through all aspects of the protection of geographical indications. This paper take the principle and interest mechanism of Economic Law as perspective, explore the combined point between Economic Law and farmers’rights protection, find the academic basis and principles of protection farmers’ rights in Economic Law, put forward a reasonable mechanism to protect farmers’rights in the view of Economic Law. The important status of farmers’rights in protection geographical indications is highlighted in the combination of intellectual property rights and Economic Law. Farmers’ rights in protection geographical indications is not conferred both in domestic and international law realm, let alone research on the close relationship of farmers’rights and protection geographical indications is unusual and rare.By analysis and comparing the protection mode and realization form in protection farmers’rights in geographical indications, this paper arrive at how to better maximize the realization of farmers’rights in the protection of geographical indications.Comparative analysis and empirical analysis is used in this paper to study the problem of farmers’rights in protection geographical indications, specific countermeasures is brought forward.This article is divided into five parts except foreword and conclusion. The first part gives a simple introduction of internationally accepted basic concept of geographical indications and protection mode, conclude and analysis the protection mode of geographical indications in China.The second part explores the base and principle of protection farmers’ rights in law realm, especially in Constitutional and Economic Law, and unveil the inherent connection between Economic Law, intellectual property right and protection farmers’rights, find out the combined point and their mutual interdependent relationship.The third part illustrates farmers’rights in protection geographical indications in other countries, summarizes their advanced experience in protection farmers’rights for our learning and reference.The fourth part and The fifth part analyze and refine farmers’rights in protection geographical indications in China, point out the difference between deserved rights and gained rights, put forward the solution and countermeasure.In a word, geographical indications protection is a long battle need the cooperation of all departments of the law realm. Awareness of important function and status of farmers’rights in protection geographical indications is the primary and necessary condition to win this battle. This paper highlights analyze protection farmers’rights in geographical indications in China from the respective of Economic Law and Intellectual Property Rights Law, discover the shortage in protection force and the fundamental reasons. Through comparative analysis of how to implement farmers’rights at home and abroad, this article gives some advice on the solution and method to protection farmers’rights.更多还原
