【摘要】 在传统中国，统治者都是通过治理官吏来达到管理社会的目的，所以“吏治”的好坏决定着一个王朝的治乱兴衰，关系着一个国家是否和谐统一。官吏作为统治者治理国家的工具，受到了统治者们的高度重视。本文通过两方面进行论述，一是官吏享受的种种法律特权从产生之日起，由于受统治者吏治观念的影响和统治的需要，受到了越来越多的限制；二是在吏治清廉思想的影响下，以及对官吏道德的高要求下，官吏因其特殊身份，相对于一般民众享有的一些重要的权利，就要被取消或限制。例如官吏不得在辖区内娶妻、官吏不得经商、官吏不得赌博等等，这些限制是吏治过程中不可缺少的一部分。同时它对于解决当今公务员职权与公民权冲突的问题有一定的借鉴作用。更多还原

【Abstract】 In traditional China, Rulers rule their countries by means of administering officials,The quality of that determines the rise and fall of a dynasty, and related to whether a stateis harmony and unity. Officials, as the tool of the ruler in governing the country, have beenattached great importance to the rulers. This article discusses that from two aspects, First,due to the influence of the rulers’ officialdom concept and their needs, officials’ legalprivilege is being restricted more and more. Second, under the influence of Incorruptiblebureaucracy thought and the demand for the officials’ morality, some important rights theyenjoy is necessary to be cancelled or limited because of their special status. For example,officials can not marry in the area under their administration, may not be in business andgambling also, etc. These restrictions are an indispensable part during the officialmanagement process. It is a good reference for solving the conflict of the civil servants’authority with civil rights in today’s society.更多还原
