【摘要】 环境问题作为人类生存和发展所面临的世界性问题,已引起国际社会的高度关注。现代各国从可持续发展的角度出发,努力变革传统经济发展模式,减少温室气体的排放,建立低碳经济发展模式继而达到保护环境的目的。因此,在可持续发展理念与资源市场化配置原则的基础上碳交易应运而生。其核心旨在：环境容量总量控制的前提下,以市场为依托,把富余的减排指标自由出售给那些未完成减排义务的主体,形成一种以碳为交易标的的环境保护模式。碳交易制度作为市场经济体制下最有效的环境保护模式己经在世界范围内被广泛采用,因此未来也必将是中国发展低碳经济的必选模式之一。但在国内还属于探索适应阶段,还存在着某些突出的理论和实践问题,这将严重影响我国低碳经济的发展,所以对该制度的理论和实践研究就显得尤为重要。随之而来,碳交易法律制度的构建也将成为世界各国立法的一项重要任务。本文针对我国现行立法中关于碳交易的基本法律规则尚未确定的问题,以碳交易的概念和内涵为基础,结合国际社会对碳交易的实践经验,运用文献评价和比较的方法,拟就碳交易的基本原则,法律制度构成,法律关系性质,交易规则模式,以及碳交易实践中存在的法律问题等为主要研究对象,探索如何在构建与我国实际相适应的碳交易法律制度、健全碳交易法律体系、完善碳交易相关配套制度等方面的途径,以供国家机关完善相关立法作参考,从而实现我国碳交易的快速健康发展。更多还原

【Abstract】 The worldwide problem of environmental issues facing human survival and development, has caused great concern of the international community. Modern countries from the perspective of sustainable development and efforts to change the traditional model of economic development, reduce greenhouse gas emissions, low-carbon economic development model and then to achieve the environmental protection. Therefore, the concept of sustainable development and resource market allocation principles based on the carbon trading came into being. Its core aims:the premise of total control of environmental capacity, market-based, free to sell the surplus emission reduction targets to those who have not completed the main body of the emission reduction obligations, the formation of a carbon-trading subject of environmental protection mode. Carbon trading system as a market economy system, the most effective environmental protection mode has been widely adopted around the world, the future is bound to be one of the mandatory mode of the development of low-carbon economy. But also in the country belong to explore the adaptation phase, there are still some outstanding theoretical and practical issues, this will seriously affect the development of low-carbon economy in China, so the theory and practice of the system is particularly important. Following this, the Construction of the legal system of carbon trading has also become an important task for the legislation of the world.Not yet been determined for the basic legal rules on carbon trading in the current legislation, carbon trading concept and content-based, combined with the practical experience of the international community for carbon trading, the evaluation and comparison of methods, the basic principle intends to carbon trading, the legal system constitutes the legal nature of the relationship, the choice of trading patterns, as well as the practice of carbon trading and legal issues as the main object of study, exploring how to build legal system compatible with the reality of our country carbon trading, and improve the carbon trading legal system, improve the carbon trading supporting systems and other aspects of the way, as a reference for national authorities to improve the relevant legislation, in order to achieve the rapid and healthy development of China’s carbon trading.更多还原
