【摘要】 海外投资是国际经济增长的重要动力。改革开放以来,特别是加入世界贸易组织之后,随着我国经济实力的不断增强,我国渐渐改变了长期以来只注重引进外资的思路,企业的海外投资活动开始呈现出良好的发展势头,成为世界上主要的发展中国家资本输出国。但是海外投资涉及到复杂的国外政治、经济因素,在实践中,我国的海外投资活动遭遇到很多政治风险,给我国的海外投资企业造成了相当大的经济损失,严重损害了我国的经济利益。以法律手段防范海外投资中的政治风险,是我国海外投资发展中迫切需要解决的问题。本文介绍了我国海外投资面临的主要政治风险,在借鉴国际社会防范海外投资政治风险的一般法律途径的基础上,对我国海外投资政治风险的法律防范机制进行探讨。全文分为前言、正文和结论三部分。正文部分分为五章：第一章海外投资政治风险概述。本章介绍了海外投资政治风险的概念和一般种类,探讨了海外投资政治风险的法律防范的意义。第二章我国海外投资主要政治风险。本章通过分析近年来我国海外投资企业遭遇东道国政治风险的一些典型案例,阐述我国海外投资企业面临的主要政治风险。第三章海外投资政治风险的一般法律防范机制。本章从国内法层面和国际法层面分别介绍海外投资政治风险防范的一般法律机制,包括国内法层面对政治风险的法律防范机制即海外投资保险制度和国际法层面对政治风险的防范机制即双边投资协定和多边投资担保机制。第四章我国海外投资政治风险的法律防范机制现状和不足。本章从国内法层面和国际法层面分别探讨了目前我国海外投资政治风险法律防范机制的现状和不足。第五章我国海外投资政治风险的法律防范机制的完善。本章就完善我国海外投资政治风险法律防范机制提出建议,在国内法层面,我国应构建我国海外投资保险体系并制定专门的海外投资的法律法规,在国际法层面,我国应完善我国海外投资的国际双边条约并注意充分运用多边投资担保机制。更多还原

【Abstract】 Overseas investment is one of the important power to promote the growth of international economic. Since the reform and opening up, especially after joining the world trade organization, China’s economic has been strengthened and our country gradually changes the thought of only introducing the foreign capital into paying more attention to overseas investment activity. Nowadays, China has become a major capital export. However, overseas investment involves complex foreign political and economic factors. In practice, China’s overseas investment activity has encountered a lot of political risks and suffered considerable economic loss. It is a urgent problem to prevent the political of overseas investment risks through legal means in the process of overseas investment.This paper introduces major political risks that our country faces in the overseas investment. It discusses Chinese legal protection mechanism for preventing political risks in the overseas investment, on the basis of the practice that the international society observers.The paper is divided into three parts:the preface, text and conclusion. The text is divided into five chapters as the following:The first chapter is the summarization of overseas investment political risk. This chapter introduces the concept and general types of overseas investment political risk, discusses the significance of the legal means for the prevention from the overseas investment political risk.The second chapter is the main political risks facing our country overseas investment. Through analysis of some typical political risks cases that China’s overseas investment enterprises encountered in the host country in recent years, this part expounds the main political risk that China’s overseas investment enterprises are facing.The third chapter is the common legal prevention mechanism about overseas investment political risk. This chapter introduces the common legal prevention mechanism about overseas investment political risk, from the aspects of domestic law and international law, including overseas investment insurance system, bilateral investment agreement, and multilateral investment guarantee mechanism. The fourth chapter is the present situation and flaws of our country’s legal protection system for overseas investment political risks. This chapter discusses the present situation and flaws of the current scheme in our country for preventing overseas investment political risks from the aspects of both domestic law and international law.The fifth chapter is the perfection of the legal protection mechanism for overseas investment political risks in China. This chapter puts forward some suggestions on the perfection of China’s legal protection mechanism for overseas investment political risks, including establishing overseas investment insurance system, formulating special overseas investment laws and regulations, improving the international investment bilateral treaty and making full use of the multilateral investment guarantee mechanism.更多还原
