【摘要】 本文以农村土地承包经营权入股流转方式为研究对象,以农村土地承包经营权入股流转相关法律调整为核心,试图通过法理、法经济学、法律的系统分析阐述农村土地承包经营权入股流转施行过程中存在的问题与解决办法。本文的架构与主要内容：第一部分,从三个地区农村土地承包经营权入股流转方式的实践分析出发,阐述了了重庆等地区农村土地承包经营权入股流转进行的组织模式,分析了三个地区农村土地承包经营权入股流转的相关政策,最后对三个地区农地入股出现的问题进行了剖析。第二部分,对农村土地承包经营权入股流转方式进行了法理分析。首先重新界定了农村土地承包经营权入股流转的内涵,然后对其经济学分析,提出了农村土地承包经营权入股流转的价值,最后分析了农村土地承包经营权入股流转过程中相关利益主体的矛盾。第三部分,对农村土地承包经营权入股流转施行过程中存在的法律障碍进行分析,以三部法律为主,对《农村土地承包经营法》《公司法》《破产法》展开讨论,分析了相关法律障碍的原因。第四部分,针对农村土地承包经营权入股流转相关法律障碍,提出完善意见,并进行总结概括。更多还原

【Abstract】 In this paper, the investigate subject is pooling of land and legal regulation about pooling of land, hoping to describe problems and solutions to those problems of pooling of land by analyses of legal principles, legal economics and systems.The framework and main contents of this article:The first part will analyze facts, models, policy and problems about three regions of pooling of land.The second part will analyze pooling of land by legal principles. Firstly, it will redefine the signification of pooling of land. Secondly, it will discuss the values of pooling of land by legal economics. At last, it will analyze the main conflicts of pooling of land.The third part will analyze legal obstacles about pooling of land based on the "rural land contracting law," "Company Law" and "Bankruptcy Law"The fourth part will discuss the suggestions on legal obstacles about pooling of land.更多还原
