我国矿产资源生态补偿法律制度研究

【摘要】 随着我国矿业的迅速发展,加上人类不合理的开发利用矿产资源,使得很多资源型城市面临环境污染危机,导致生态失衡,给当地居民带来了巨大的损害,如何减少和遏制矿产资源开采对环境的破坏,使矿区生态环境得到修复,已经成为我们亟需解决的问题。解决这一问题的途径之一,就是建立和完善矿产资源生态补偿制度。本文首先剖析了矿产资源生态补偿的法律内涵,进而阐述了矿产资源生态补偿的理论基础,然后通过对国外发达国家矿产资源生态补偿发展情况的考察,总结出了切合我国国情的一些有益措施,并对其进行了认真分析,在此基础上对我国矿产资源生态补偿制度建立提出了相应的完善措施,希望以此来解决我国矿产资源开发利用所带来的环境问题。更多还原

【Abstract】 With the rapid development of China’s mining industry, coupled with the irrational development and utilization of mineral resources, makes a lot of resource-based cities are facing environmental crisis, leading to ecological imbalance, to the local residents brought great damage, how to reduce and curb the exploitation of mineral resources damage to the environment, the ecological environment in mining areas have been restored, has become an urgent need to resolve. One way to solve this problem is to establish and improve the ecological compensation system for mineral resources. This paper analyzes the mineral resources in the legal meaning of ecological compensation, and then expounded the theory of ecological compensation of mineral resources base, and mineral resources in developed countries through the development of ecological compensation in the study, summed up the situation of our country to meet a number of useful measures and were carried out careful analysis, on the basis of ecological compensation system for mineral resources, China proposed to establish the appropriate measures to improve, hoping to solve the development and utilization of mineral resources caused by environmental problems更多还原
