【摘要】 随着城镇化的加速推进,城市建设用地供需矛盾显现,面对巨大的需求,城市建设用地数量有限,人们将目光投向数量巨大的农村集体建设用地。农村集体建设用地使用权流转在不改变土地所有权的前提下,将存量农村集体建设用地或者办理了批准手续的增量农村集体建设用地的使用权进行转移,进而盘活农村集体资产,也增加政府的税费收入。更为重要的是,这样做可以减少无序隐性流转带来的市场失灵,带来更多的社会效益。伴随着农村改革,土地流转快速发展,原有的管理方式已不适应现在的需求,农村集体建设用地的监督和管理出现缺位。农村集体建设用地使用权流转中出现了土地资产流失、小产权房、土地利用重视经济效益忽视社会生态效益等市场失灵现象,这就迫切需要政府的干预。政府介入集体建设用地的使用权流转可以采取制定土地规划、统一市场建设、监督管理、为新农村建设提供资金来源等方式。当前农村集体建设用地使用权流转过程中,政府的干预也存在缺陷,甚至可能出现政府失灵。要预防和矫正政府失灵,就必须切实转变政府作用,科学划分部门之间的定位,上下级政府、部门之间进行分工,并且采取强化乡镇的土地执法监察作用、建设服务型政府、明确各级职责、划分部门作用、明晰产权、提供制度保障等一系列措施。更多还原
