企业劳资关系法律问题研究

【摘要】 企业劳资关系作为经济社会中生产关系最基本、最重要的组成部分,深刻影响着社会经济结构的形成与发展,而经济结构的稳定又决定了社会结构的稳定。对于正处于经济和社会转型时期的我国,规范劳资关系的法律规章制度不健全,相关劳动立法不完善,与劳资关系有关的经济法律滞后于经济活动的发展,使得资本有机可乘,侵占劳动者的利益,侵犯劳动者权益的情况屡见不鲜。劳资关系不仅是经济和社会问题,更是政治问题。劳资矛盾与冲突日趋表面化和常态化,劳资冲突己经成为影响我国经济与社会发展的最突出的因素,劳资关系问题已经成为企业健康发展不可回避的敏感话题,直接影响到我国经济的发展和社会的和谐。和谐与稳定的劳资关系的构建,离不开相关法律法规的规范和完善。只有在建立健全劳动立法体系的基础上,完善保护劳资双方权益的法律制度,劳资关系才能做到有法可依。从经济法学的角度研究企业劳资关系存在的问题,分析劳资关系问题产生背后的经济、法律根源,探求规范我国劳资关系的法律的现状,剖析相关法律制度缺失对劳资关系的影响,探讨我国劳动立法的现状与不足,探索新的经济形势下,企业劳资关系对法律法规的需求,实属必要。在此基础上,结合政治、法律、社会道德等层面,研究探求平衡劳资关系的政策、经济、法规之道,合理运用法律政策制度规范劳资关系、协调双方利益,保护劳动者的合法、正当的权益,促进企业健康稳定发展,促进社会的公平与正义。

【Abstract】 Enterprise labor relations, the most basic and important part of relations of production in the economic society, has a deep impact on the formation and development of social and economic structure.The stability of the economic structure determines the stability of social structure.Now in economic and social transition period in China, rules and regulations to standard labor relations and legislation related to labor are imperfect. Labor relations laws’ laging behind the development of economic activities makes the capital occupy workers’interest and violate the labor rights.Labor relations is not only the economic and social issue, but also a political issue. Labor conflicts tend to be apparent and nomalized, and labor conflicts have already become the most prominent factor in affecting our country’s economic and social development.Labor relations have become an unavoidable and sensitive topic to the sound development of the enterprise, and it will directly affect the development of our national economy and social harmony.The construction of harmonious and stable labor relations must rely on the standardizing and improvement of relevant laws and regulations.Only on the basis of establishing and perfecting labor legislation system to perfect the legal system and protect rights and interests of employers and employees can we have the labor relation laws to abide.It mainly researches the existing problems of enterprise labor relations from the angle of economic law and analyzes the economic and legal source behind it in this article. It also explores the legal norms of the status of labor relations, analyzes the inflence of relevant legal system’s lacking to the labor relations and discusses the present situation and shortage of labor legislation in our country. Then, it tells us it is necessary to explore the enterprise labor relations during new economic situation. On this basis, combining with political, legal and social moral aspects, it explores the policy and economy regulations to balance labor relations, it also explores we should make reasonable use of legal policy system to standard labor relations, coordinate both parties’ interests and protect the labors’ legal rights,make enterprise have an healthy and stable development, and promote social justice and fairness.
