【摘要】 随着我国经济发展的提速,水资源需求日渐增多,但污染问题日益严重,备受关注,水污染防治这一具有公共事务性的举措其重要性不言而喻。那么,如何在水污染防治体系中完善政府责任,通过政府领导对水污染进行综合治理显得尤为重要。本文运用文献归纳、价值分析和比较等研究方法,综合了环境法、法理学、行政学、伦理学等方面的知识,对水污染防治中的政府责任展开讨论。本文由政府在公共事务管理中的责任界定入手,用理论和数据实例证明水污染防治的公共事务性,近而明确界定水污染防治中政府承担责任的范畴,揭示水污染防治中明确政府责任的必要性。系统阐释了水污染防治中政府责任承担的理论基础,包括现代宪政理论、利益衡量理论、环境公平理论、公共信托理论等。以《中华人民共和国水污染防治法》为切入点,在着重分析我国水污染现状的基础上深入探究我国水污染防治中政府责任的相关立法规定及制度研究,从而指出无论是政府的管理模式还是政府的责任机制中都存在些许不足,并针对存在的问题考察了美国、法国、日本及澳大利亚等国家在水污染防治中针对政府责任的相关立法规定及制度实践,从他们的成功经验中获取我国在防治水污染中的启示:即通过明晰政府管理责任,强化政府服务责任和健全政府救济责任等手段来实现完善我国水污染防治中政府责任的途径。更多还原

【Abstract】 With the increased speed of our nation’s economic, the water resources demand increases day after day, but the contamination concern is more and more serious and has become a focus of all society. Needless to say, prevention and control of water pollution is very important. Then, how to improve government responsibility on water pollution prevention system, and how to carry on the comprehensive program of public order seem especially important.The article, with the methods of documentary value analysis, as well as the method of comparison and so on, synthesizes various knowledge such as environmental law, jurisprudence, the administrative law, ethics etc. Try to fully discuss the government responsibilities on the prevention and control of water pollution.The article is based on the Law of the People’s Republic of China on the Prevention and Control of Water Pollution, starts with the actualities of water pollution, discovers the reasons for water pollution, then defines the government responsibilities on the prevention and control of water pollution, and explains the theory basis of it, such as modern constitutional theory, interests measure theory, environmental equity theory. Reviewing in the United States, France, Japan and Australia and other countries in the water pollution prevention and control of the relevant legislation against the government and institutions, we can derive some successful experience. The paper also analyzes water pollution state and related provisions in our nation’s regulations of the government responsibilities on the prevention and control of water pollution, pointing out the insufficiencies and putting forward a series of consummating measures.更多还原
