【摘要】 警察职务犯罪是指人民警察在执行警察职务的过程中,侵犯国家对警察职务管理法律的规定,并依法应受到刑罚处罚的行为。近年来,我国频发警察职务犯罪案件,并且数量呈现出上升趋势。亵渎了国家赋予警察的神圣权力,疏离了人们对社会基本价值的信仰,严重影响了警民关系。由于警察职务犯罪不同于其他类型的犯罪,对警察职务犯罪的危害性的认识比较困难。同其他犯罪相比具有如下特点:一是职务犯罪危害的掩盖性。二是警察职务犯罪危害的深远性。三是警察职务犯罪危害的多重性。警察职务犯罪有客观和主观两个方面的原因。客观原因包括政治因素,警察权力的异化是警察职务犯罪产生的一个重要政治因素。制度因素,我国的一些警察制度在可操作性方面还存在着一些缺陷,没有形成切实有效的制度体系。主观因素包括警察个人心理问题,不恰当的认识和消极的人生观等方面。警察职务犯罪的可致性、因果性规律性可以得出警察职务犯罪的预防具有可行性。在警察职务犯罪预防方面的具体措施主要通过完善现有的法律制度,警察管理制度。通过教育预防使警察树立正确的人生观和价值观,并根据警察职业的心理问题提出有针对性的心理预防措施。公民、媒体和公安机关内部要做好监督工作,督察人民警察依法履行职责,有效防止警察职务犯罪的发生。更多还原

【Abstract】 Police duty crime is the people’s police in the course of carrying out police duties, violated the state law office management, and should be subject to criminal punishment. In recent years, the police crimes frenquency is showing a rising trend. And it desecrate the sanctity the police power that the state has given, alienated the basic social values faith of the people, cause a serious impact on public relations.Crimes of the police is different from other types of crime and the awareness of the dangers of such crimes is more difficult. Compared with other crimes, police crime has the following characteristics: First, the cover up of harmfulness of the duty crimes. Second, the depth of the harmfulness of the police duty crimes.Third, the multiplicity of the police duty crime harmfulness.Police Crimes has objective and subjective reasons. Objective reasons includes political factors, the alienation of the police powers is one of an important political factor. Institutional factors, there are still some shortcomings in operational terms within our police system, and effective institutional system has not been formed. Subjective factors include personal psychological problems, incorrect knowlege and negtive outlook on lige and so on.It is possible to prevent Police Crimes due to the regular pattern of consistency and causality of the crimes. The specific measures to preventpolice duty crime is mainly through the improvement of the existing legal system and police management system. To make the police establish a correct outlook on life and values through education, and according to police professional psychological issues, to take psychological preventive measures. Citizens, the media and the internal public security organs should stress supervision work to make sure the people’s police perform their duties according to law, and prevent effectively the occurrence of crime更多还原
