【摘要】 知识产权制度是随着科学技术和商品经济的发展而出现的一种法律制度。尽管知识产权法律制度的历史并不算长,但就在这短短几百年里人们对于其合理性问题的研究和争论从未中断过。随着知识的爆炸性增长,人们对于知识产权的需求变得更为迫切,但由于知识产权法律制度的存在却在很大程度上阻碍了知识的传播,并缩小了人们利用知识产品的机会。正是在这一情况下,使得越来越多人甚至包括研究知识产权方面的学者对知识产权法律制度存在的合理性产生了质疑。虽然现有的各种知识产权理论大都在努力地论证知识产权的合理性,但由于它们所各自持有的不同视角和立场,使得每一种理论的局限性同其优势一样明显。基于此,本文对当今有关知识产权研究具有重大影响的三大理论进行了梳理,并通过分别对知识产权劳动理论、人格理论以及激励理论辩证的分析,并指出这三种理论渐渐趋于整合的趋势,进而从更深层次上指出为了顺应社会弱化权利并加强利益分享的需求,我们对于知识产权研究以及知识产权法律制度的调整所应持有的立场,即坚持分配正义和工具论。更多还原

【Abstract】 The Intellectual property system is a kind of legal regime which appears along with the development of science、technology and commodity economy. Although the history of intellectual property rights legal regime is not long, There has been a lot of scholarly discussion on this topic. Go along with the knowledge growing explosively,people are becoming asking for more and more kinds of knowledge,but the disseminate way of intellectual has hindered because of the existence of the legal regime of Intellectual property right,besides there are fewer chances to use intellectual products.In this situation,there are more and more people including many investigators on the research of Intellectual property right become to question the legitimacy of the legal regime of Intellectual property right. Although every theory existed is trying its best to justify intellectual property,because these theories have different angle of view every theory gets visible advantage and limitation.So This article reviews three theories of justification for intellectual property by means of dialectical analysis on these three theories of justification for intellectual property :the labor theory,the personality theory,and the motivation theory,meanwhile show the readers the integration tendency of three theories.For the benefit of the society the rights of Intellectual property mast be weakening and benefit of society mast be strengthening sharing,in this case,we should rectify the standpoint on the research of the legal regime of Intellectual property in this case take the theory of distributive justice and instrumentalism will be a good choice.更多还原
