我国食品安全与政府监管研究

A Study on the Chinese Government Regulation of Food Safety

【摘要】 面对我国层出不穷的食品安全事件,食品安全领域的监管问题再次受到关注。长期以来,学术界和实务界对到底是依靠政府监管还是依靠社会共管并无统一的认识,导致目前食品安全由谁监管,由谁负责的问题纠缠不清。传统观点认为,食品安全监管的主体是政府,对于食品安全监管的改革也是按照行政性监管的思维而展开。而从治理理论的角度而言,政府部门只是具有权威性的治理主体之一,多元共治更强调包含政府的各种社会组织的共同治理。本文在分析目前国内食品安全监管现状及问题的基础上,发现由于我国特殊的实际情况以及食品安全问题的特殊性,目前我国食品安全监管的主体仍然是政府。但是,本文中的政府监管并不等同于传统的政府监管,通过对欧美国家食品安全监管经验借鉴的基础上,针对现在政府监管中存在的问题,提出了新时代背景下我国政府关于食品安全的监管对策和建议。

【Abstract】 Because of the emerging food safety incidents in China, the regulation of food safety is concerned again. For a long time, there is no uniform understanding about the regulation which by government or by market in academia and practice area. Therefore, it is a topic that who should to be responsible for food safety regulation. For the traditional view, government is the main part of the food safety regulation. On this basis, that we reform the food safety regulatory is also accordance with the Administrative supervision. From the perspective of government theory, government departments are just one of the main authoritative governance. Food safety regulation needs more emphasis. In this paper, by analyzing the present situation and the domestic food safety regulatory issues, I think the main part of the food safety regulation is still the government. This conclusion is based on domestic actual situation and the particularity of the food safety issues. Then by drawing the experience of the United States and the European Union, combined with domestic actual conditions, I put forward the measures and recommendations of the government food safety regulation in the new background.
