药害事件损害救济制度研究

【摘要】 药品作为一种特殊商品,利益与风险并存,在治疗疾病的同时也会导致损害。20世纪以来,各国生物医药技术迅猛发展,极大的改善和提高了人们的生活质量和健康水平,但同时也产生了大量的药物损害。百年来,世界性药害事件不断发生,造成的人员伤亡、经济损失难以估计。2006年以来,我国频频发生药害事件,影响较大的有“齐二药”事件、“甲氨喋呤”事件等,引起全社会的关注,给受害者造成巨大的人身伤害,不仅侵害了人们的生命健康权,也在一定程度上影响了公众对医药行业的信任。但由于目前我国缺乏专门的药害事件损害救济制度,这些事件发生后的善后救济无法得到妥善处理,受害者的权益得不到有效保障,已经引起社会各方的密切关注,也使监管部门意识到建立药害事件损害救济制度的必要性。纵观历史,美国、德国、日本等发达国家从上世纪六、七十年代起,就经历过多起严重的药害事件,通过多年的实践研究,上述国家包括我国台湾地区在药害事件损害赔偿上积累了丰富的经验,形成了一套较为成熟的损害赔偿机制,通过政府赔偿、企业保险、社会基金等多种方式对受害者进行赔偿。本文立足于公众和政府视角,将药害事件内涵设定为药源性损害,从更广泛的范畴对药害事件损害救济机制进行制度设计。首先对药害事件的概念和分类进行简述,收集我国近年来发生的药害事件及损害赔偿情况,分析我国近年来药害事件频发的原因,并通过对药害事件各方的调查问卷开展药害救济实证研究,从而归纳我国现有药害事件赔偿的基本概况和救济困境。其次通过对美、德、日等国以及我国台湾地区相关药害救济制度的分析和比较,总结各国救济制度的共有原则和救济方法。再次,学习和借鉴各类药害救济制度的优点,通过对我国现有的食品药品损害救济方式的比较分析,从实践出发,倡导建立符合我国国情的,政府主导环境下各责任方共担风险的药害赔偿救济制度,设立专项救济基金和专门的处理机构,确保药害事件受害者能够及时、有效地获得救济,完善我国的社会保障体系。
【Abstract】 As a special commodity,the drug peovides both the benefit and the risk.In the past one hundred years,wordwide Drug misadventures happened frequently, which aroused close attention from people,and made regulation authorities aware of the necessity to establish Social Security System.First, this paper, by studying the accidents of Drug misadventures as well as its compensation and doing some surveys on it for empirical study, analyzed the problems of current relief system for Damage compensation from Drug Misadventures in China PR. Then, the paper analyzed the relief system for Damage compensation from Drug Misadventures in the United States, German, Japan and Taiwan, and summarized the affinities and characteristics of the system among those countries, in order to advocate founding the relief system for Damage compensation from Drug Misadventures which is suitable to China’s national situation and lead by the government, and whose risk is taken by different responsible parties. In addition, the paper is also expected to help ensure the victims of Drug Misadventures can get their compensation timely and efficiently, and help improve the Social Security System in China.
