我国“小产权房”法律问题研究

【摘要】 “小产权房”如雨后春笋般出现在中国大地上,“小产权房”这一概念也在社会生活中逐渐形成一特定的称谓。在城市商品房价格不断攀高、政府调控不力、城市住房保障措施不到位、我国土地资源日趋稀缺的背景下,全国几乎所有大中型城市及其近郊,均出现不少开发建设、销售的“小产权房”。无论是建设数量还是市场需求,“小产权房”的规模都相当庞大。但是在学理或者法律上还没有形成一个规范的解释,而且涉及的法律问题纷繁复杂,其中不仅有立法相对滞后以及法律适用上的冲突产生的问题,还有现实中利益分配格局情况复杂、诸多违法现象产生的问题。因此,研究如何解决“小产权房”的问题就具有重要的理论意义和现实意义。本文共分为四个部分,第一部分是对我国“小产权房”存在的基本问题进行说明,以期得到对其整体上的认识。首先对“小产权房”的概念进行界定,阐明本文所要论述的对象,然后概括小产权房的特点,对其现阶段的积极意义和消极影响进行了阐述。第二部分评述了小产权房的存在现状和法律规制现状,从小产权房的存在现状和尚不适法性的现状出发,力图阐明其存在的各种问题。第三部分阐释了小产权房产生的根源,城市房价上涨、新农村建设、地方政府管理不到位等共同构成了“小产权房”产生的外驱力;我国的土地二元制度和农村集体建设用地存在的流转空间是产生小产权房的内驱力。第四部分提出了解决“小产权房”的理论基础和具体方案措施。
【Abstract】 "The Informal Property Rights" have sprung up in the land of China, the " the Informal Property Rights " concept of social life are gradually formed this particular title. Constantly rising housing prices in the city, government regulation ineffective, urban housing security measures in place, increasing scarcity of land resources background, nearly all large and medium cities and their suburbs, there have been many development and construction of all, sales of " the Informal Property Rights . " Both the quantity and construction of market demand, " the Informal Property Rights " of the scale are quite large. However, theoretical or have not formed a legal interpretation of a specification, and the complicated legal issues involved, which is lagging behind not only the legislative and legal application of the conflicts problem, there are real complicated pattern of distribution of benefits, many illegal phenomenon of the problem. Therefore, studying how to solve the " the Informal Property Rights " in question has important theoretical and practical significance.This article is divided into four parts, the first part of our country, " the Informal Property Rights " described the basic problems exist, in order to get their overall understanding. First, the " the Informal Property Rights " concept to define, clarify the object of this paper is to discuss and then summarize the characteristics of house property to its present stage of the positive and negative impacts are described. Part II reviews the existing situation of small property room situation and legal regulations, the existence of small property status of the Housing Act of monks is not the current situation of trying to clarify the various problems of its existence. The third part explains the causes of small-property real estate students, urban housing prices, new rural construction, and other local governments are not in place constitute a " the Informal Property Rights " from the external drive; our system and the rural collective land , The circulation of land for construction of space there is to generate the internal driving force small property.
