【摘要】 法律活动是具有目的性的社会实践活动。研究银行扶持企业发展低碳经济法律制度不仅可以指引立法,还可以指导法律实践,指明学术研究的方向。随着经济发展与资源环境之间的矛盾日益加剧,发展低碳经济不光是应对气候变化的客观需要,还是可持续发展的内在要求。过去,人们总把对环境的保护的目光侧重于初级产品的制造业和生产部门。如今,人们终于认识到金融服务业才是实现可持续发展的关键环节。银行及其他金融机构有能力把资源引向环境表现良好的项目或企业。银行及其他金融机构为重大项目或企业提供资金支持时,有责任评估、监督该项目或企业对环境及社会的影响。截止到目前,国内尚无专门研究银行扶持企业发展低碳经济法律制度的学术著作问世。然而在国外,对银行扶持企业发展低碳经济法律制度早已进行过深入探究,国内却很少引进。我国国内外现实显示出我国银行扶持企业发展低碳经济的迫切性,同时也反映了我国银行扶持企业发展低碳经济将面临诸多挑战,加快完善银行扶持企业发展低碳经济相关法律政策,建立有利于低碳经济发展的法律体系是不可或缺的。本文从银行扶持企业发展低碳经济的角度,分析了完善银行扶持企业发展低碳经济法律制度的原因,借鉴国外银行在扶持企业发展低碳经济的成功经验,从构建低碳信贷法律制度、建立银行扶持低碳经济企业的激励机制、建立银行扶持低碳经济企业的监督法律制度等方面提出设想,以推动低碳经济在中国的发展。更多还原

【Abstract】 Legal activities are purposive social practices. Research on the purpose theory of the legal system can provide guidance on the legislation, help to solve the hard problem of choice, instruct legal practice, and demonstrate the direction of academic research. With the growing conflict between economic development and resources environment, the development of low-carbon economy is not only the need of climate change, but also the inherent requirements of sustainable development. In the past, Current environmental protection lays particular emphasis on the primary products of the manufacturing and production sector. But nowadays, people finally realized that the financial services industry is the key to achieving sustainable development. Banks and other financial institutions have the ability to turn resources toward environmental projects or enterprises with good performance. Banks and other financial institutions or enterprises, which give major projects financial support are responsible for assessing, monitoring of the project or enterprise on the environment and society.The only few academic papers hold differing opinions and old ideas. However, the research abroad on the purpose of the banks supporting enterprise development perspective of low-carbon economy law have been in the depth and detail but hardly introduced into China.The environmental reality in domestic and international shows the support for the enterprise of the development of low-carbon economy by banks is urgency. Meanwhile, it also reflects the supportive policies in China will be faced with quite a number of challenges. Accelerating the improvement of relevant laws and policies and establishing legal system for low-carbon economic development is indispensable.This article starts from the banks supporting enterprise development perspective of low-carbon economy, analysis on the necessity of consummate legal system in supporting low-carbon economy. And we will learn from foreign banks’successful experience to rough out some ideas in building low-carbon credit from the legal system, building financial supporting motivation system and supervision system of banks to promote low carbon economy in China.更多还原
