【摘要】 随着对城市老城区改造步伐的加快以及对公共基础设施的大幅建设,房屋征收已经成为当今人们关注的焦点,其中,由于征收补偿关乎被征收人的重要利益,因此,我国有必要形成一套完善的房屋征收补偿制度体系,以保障被征收人实体权益。令人瞩目的是2011年1月21日《国有土地上房屋征收与补偿条例》颁行,本法弥补了以前补偿制度中的不足,对保障被征收人的权益提供了良好的制度依据。本文将依据现行《国有土地上房屋征收与补偿条例》,对我国当今的征收补偿制度作出分析,同时对其存在的一些不足予以阐述,并提出相应的建议。本文除了引言和结语之外,全文共分为四章。第一章,国有土地上房屋征收补偿的相关概念及性质界定。第二章,我国国有土地上房屋征收补偿制度的构建。其中将通过六个部分进行阐述,即：征收补偿原则、征收补偿主体、补偿范围、补偿方式、补偿标准、补偿程序。通过对本部分的讲述,将对当今征收补偿制度有更深的了解。第三章,我国国有土地上房屋征收补偿制度的缺陷。本章将对其补偿范围、补偿方式以及补偿程序上的缺陷做出简要分析,并引出下一章解决问题的建议。第四章,对我国国有土地上房屋征收补偿制度完善的建议。具体为：完善补偿范围、改进补偿方式和修正相关补偿程序。更多还原

【Abstract】 Along with the speeding up to the reforming of the old city area and the significant construction to the public infrastructure,the expropriation of the house has already became the focus that people concerning nowdays,at the same time,because of the expropriation of the house affecting the person’s important benefits,therefore,it’s necessary to our government establish a set of perfect system which about the expropriation of the house to protecting the entity rights to the person whose houses have been imposed. Making what person focus attention is <The regulation of the expropriation to the house on the state-owned land and the compensation >had issued on January 21st,2011,this law has made up to the shortage in the system before,gived a good system foundation to the protection to the person whose houses have been imposed.According to the <The regulation of the expropriation to the house on the state-owned land and the compensation>,this text will make an analysis to the system of the expropriation and the compensation nowsdays,at the same time elaborates the shortage of it and put forward the homologous suggestion.The text is divided into four totally in addition to preface and conclusions.At the first part,this text will talk about the concept and the nature to the expropriation and the compensation on the state-owned land.At the second part,the construction of the system of the compensation on the state-owned land.There are six parts,the principle of the expropriation and the compensation,the corpus of the expropriation and the compensation,the scope of the compensation,the way of the compensation,the standard of the compensation,the procedure of the compensation.By the relation of this part,we will have a deeper understanding to the system of the compensation.At the third part,the blemish of the system of the compensation.
