【摘要】 随着世界经济一体化进程的不断推进和我国改革开放的不断深化,我国市场经济建设取得了显著成效,工业化进程有了极大的提高,但是与此同时,环境污染问题和生态破坏问题日益突出,对人民的生产和生活造成严重影响,在一定程度上也阻碍了我国经济与社会的可持续发展的进程,同时也与建设和谐社会的要求不符。中国共产党第十七次全国代表大会上,我们党提出了实现全面建设小康社会的新要求,其中建设生态文明是新要求的应有之义。为了响应党关于生态文明建设的号召,为了更好的促进和谐社会的建设,提高国民环保意识是必要的,但通过制度的创新来规制环境污染行为是更具可行性和可操作性方式。环境责任保险是责任保险制度与环境侵权制度相结合的典范之一,是风险责任社会化在环境侵权领域的最新发展。这种风险救济机制,不仅可以为投保人转移责任风险,而且还可以及时为受害人提供保护。但是环境责任保险在我国尚处于起步阶段,险种和承保范围等相对局限。本论文通过对环境责任保险一般理论、环境责任保险制度的理论基础、国外环境责任保制度的发展实践、我国环境责任保险制度的现状及问题分析等问题的研究,以期为我国环境责任保险制度的发展完善提供基本思路和制度借鉴。更多还原

【Abstract】 With the development of world economic integration and China’s reform and opening up, we have made great progress and achieved remarkable achievements especially in the industrialization. However, environmental pollution and ecological damage have became increasingly prominent, which severely affect people’s life and production and also hinder china’s economic and social progress of sustainable development to some extent. And these are inconsistent with the requirements of building a harmonious society.In the 17th national congress, our party has put forward a comprehensive new requirements for a moderately prosperous society. And the construction of ecological civilization is the proper meaning of the new requirements.In response to the call of ecological civilization construction, to my point, it is necessary to raise national awareness of environmental protection, and what’s more, it is a more feasible and workable way to regulate behavior of environmental pollution by the innovation of the system.Environmental liability insurance is one important example of a combination of the liability insurance system and environmental tort system, which is the latest development in the field of environment tort. It could not only transfer the liability risks of the policy holder but also provide protection to victims in time.However, environmental liability insurance is still in its infancy in china. In order to obtain the perfections of environmental liability insurance system in China, through the study on the theory of the environmental liability insurance system, the development of environmental liability insurance system overseas, the status and problems of environmental liability insurance system in China and so on, I could provide the train of thought and suggestions for the perfections of the environmental liability insurance system in China.更多还原
