【摘要】 突发公共事件中的政府信息公开有利于稳定社会秩序,保障人民群众的生命财产安全,同时也有利于促进政府行为的公开与透明,是我国行政法治尤其是紧急法制建设的关键步骤。当前我国已经展开了关于突发公共事件中的政府信息公开研究,相关立法也有所涉及,但是由于突发公共事件中的信息公开横跨信息公开法制和突发事件应对法制两大部分,因此显得较为复杂,有待进一步研究。本文即以突发公共事件中的信息公开为研究对象,在主要内容上主要分为如下几大部分：第一部分是引言,主要介绍了本课题的研究背景、研究现状、研究目标以及研究方法和目标。第二部分是突发公共事件信息公开的基本问题。本部分主要介绍了突发公共事件中信息公开相关概念和基本理论,尤其是对突发公共事件中政府信息公开的必要性和理论基础进行了解读；第三部分是我国突发公共事件信息公开制度的现状与不足。本部分简要分析了我国突发公共事件信息公开法制的发展历程与现状,指出当前我国突发公共事件信息公开法制存在缺乏“权利-义务”构造、缺乏明确的公开范围、缺乏明确的公开程序以及缺乏救济与监督机制；第四部分是突发公共事件信息公开比较研究及其借鉴。本部分主要以比较法学的研究视角对国外突发公共事件信息公开问题展开了分析,认为国外的突发事件信息公开除了有明确的立法之外,还存在一些配套机制如新闻自由制度等支撑,值得我国学习借鉴；第五部分是完善我国突发公共事件信息公开机制的建议。本部分主要从突发事件信息公开法制的基本原则、突发公共事件政府信息公开的内容、突发公共事件政府信息公开的关系协调以及突发公共事件政府信息公开的法律责任等几个方面,对我国突发公共事件信息公开法律制度的构建提出了一些建议。更多还原

【Abstract】 Governmental Information publicity in public emergencies which is a key element in current legislation keeps social stability and protects people’s life and property. The scholars research information publicity in public emergencies and some laws are legislated, however, the theories and practice of information publicity in public emergencies is complicated, so it is worthy to research fatherly. This dissertation researches the legal system of information publicity in public emergencies as following:The first part is brief introduction, this part introduces the background, the main content, the researching methods and purpose. The second part is fundamental issues in information publicity in public emergencies. This part researches the necessity and theoretical basis of information publicity in public emergencies. The third part is current situation of information publicity in public emergencies and its deficiencies. This part introduces the history and current situation of information publicity in public emergencies and points out that the legal system of information publicity in public emergencies lacks of Right and Responsibility structure, definite range of information publicity, legal procedure of information publicity and right remedy system and supervision system. The fourth part is comparison research of information publicity in public emergencies. This part researches foreign laws on information publicity in public emergencies and maintains that some experience in foreign law should be adopted by China. The last part is suggestion for the construction of legal system of information publicity in public emergencies. This part put forwards some suggestion on the principles, main content, relationship coordination and legal responsibly of information publicity in public emergencies.更多还原
