【摘要】 20世纪末,为紧急治理内蒙古草原地区生态环境恶化,构建和谐社会,我国实施了“生态移民”政策,取得了明显的效果。然而,过去十几年的内蒙古生态移民实践告诉我们,一项生态移民工程要取得良好的效果,生态移民者的合法权益必须得到充分的尊重和保障,反之,不但使生态环境继续恶化,同时也会破坏社会的和谐稳定。本文共分为四个部分。第一部分,介绍了相关概念,阐述了可行能力理论;第二部分,介绍了内蒙古生态移民的概况及内蒙古生态移民权益保障存在的问题,如政府对生态移民的政治自由权利、财产补偿权、平等的社会机会权、获得足够信息的权益、社会保障权保障不足等;第三部分,主要是运用可行能力理论,从政府行政责任缺失的角度分析了内蒙古生态移民权益保障存在问题的原因:生态移民的参与与申诉机制不健全、生态移民的补偿制度存在缺陷、与移民享受平等的教育以及就业机会相关的配套措施不健全、政府信息公开制度不健全、生态移民的社会保障缺失等;第四部分,主要提出了加强生态移民权益保障的具体对策:建立生态移民参与与申诉制度、完善生态移民的经济补偿制度、完善与生态移民享受教育、就业机会相配套的措施、加强政府信息公开、建立和完善生态移民社会保障制度等。本文通过对内蒙古生态移民权益保障存在的问题、原因进行分析,进一步提出了具体的对策和建议,为国家更有效地推进和完善“生态移民”政策提供借鉴。更多还原

【Abstract】 At the end of the 20th century,to manage the deterioration of ecological environment in Inner Mongolia Autonomous Region and build a harmonious society, the Chinese Government the police of“cological migration”and achieved significant results. However, the ecological migrants practice in Inner Mongolia over the past ten years tells us that the lawful rights and interests of ecological migrants must be fully respected and protected,if you want to get good results.Otherwise, it will not only achieve the purpose of improving the ecological environment , but would also produce a lot of social conflicts.This article is divided into four parts. The first part introduces the Related Concepts,such as the Ecological migration、Interests of ecological migrants . And it introduces the Capabilities theory. The second part describes the general situation and the ststus of ecological immigrants of Inner Mongolia,and introduces the problems of the protection of ecological migrants in Inner Mongolia Autonomous Region,such as that the government can not protect the right of political freedom、the right to be compensated、the right to enjoy equal opportunities in society、the right to get adequate information、the right to social security of ecological migrants. The third part mainly analyses the cause of the problems with the Capabilities theory ,such as the participation and redress mechanism of the ecological migrants is not perfect, the defect of compensation system for immigrants、supporting measures that the equal educational and employment portunities Immigrants enjoy are not perfect、open system of government information is not perfect and social protection of ecological migrants is loss.The forth part mainly proposes the specific measures to strengthen the protection of the ecological migrants:istablish the participation and complaints system of ecological migrants,improve the economic compensation system for ecological migrants,improve the supporting measures related the equal educational and employment opportunities ecological migrants enjoyed,Strengthen the government Information disclosure ,establish and perfect the social security system of ecological migrants and so on .Based on the analyzing the problems and its reasons ,this article puts forward concrete measures and proposals.It will provide the reference to our government promoted and improved the“ecological migration”policy more effectively.更多还原
