有关我国快递的法律问题研究

【摘要】 快递是市场经济高速发展的产物,其服务对象涉及各行各业,在为国民经济增长作出巨大贡献的同时,快递也引发了不少法律纠纷。本文立足于我国快递的法律制度,分析了快递引发的诸多法律问题及相关纠纷的解决方式,并提出个人的立法意见。全文共分七章：第一章系统地介绍了快递的基本内涵和我国快递的产生及发展现状。第二章分析了快递与邮政的法律关系,并介绍了快递业与邮政业的相关法律纷争、快递和邮政管理机构的法律关系以及快递与邮政专营权的关系。第三章介绍了WTO规定的快递市场准入规则和我国新《邮政法》规定的快递市场准入条件。第四章针对快递与物流的法律关系作出梳理,得出快递是物流的子行业的结论,并且对二者的立法规定作出整理与比较。第五章介绍了电子商务的基本内涵,阐述了电子商务与快递之间相辅相成的法律关系,并着重分析了电子商务快递涉及的典型法律问题。第六章就由于快递公司的过错导致快件遭受损失而引发的相关法律责任进行逐一分析,其中涉及快件遭受损失的索赔因素、索赔程序、争议解决方式以及快递企业的免责因素和快递公司格式条款的相关法律效力等内容。第七章指出目前我国快递法律制度的缺陷,并有针对性地提出个人建议。更多还原

【Abstract】 Express appeared with the rapid development of market economy. Almostly, its customers include all kinds of industies. Beside the great contributions to the economic development, express has caused a lot of Legal disputes. This thesis bases on the chinese legal system, analysises many legal relations and legal problom of express, and makes some Legislative proposals.This thesis is composed of seven chapters.The first chapter introduces the basic connotation of express and the condition of chinese express industry.The second chapter analysises the relationship of express and postal, introduces the relevant regulations made by the new "postal law".The third chapter introduces the provisions of express company’s market accessChapter four specifies the legal relationship about express and logistics, also compares the different of their Legislative system.Chapter five introduces the basic concept of electronic commerce, and analysises the legal relationship about express and e-commerce. The emphasis of this chapter is to solve the the legal disputes about e-commerce’s express.Chapter six analysis the legal responsabilities caused by express companies and introduces some relative legal regulationsChapter seven points out the defects of chinese express legal system and gives some feasible proposals.更多还原
