地方政府与行业协会建立良性互动关系研究

【摘要】 20世纪70年代以来,世界各国各地区纷纷出现“市场失灵”和“政府失灵”的现象。在“政府失灵”和“市场失灵”的情况下,需要“第三只手”才能解决问题,第三部门作为自发组织的志愿性组织,它有效地弥补了政府和市场的不足,并以其独特的非营利性而受到广泛关注。行业协会作为非营利组织的一种形式,它有效弥补了市场和政府在公共产品供给上的不足,在公共服务和公共管理中扮演了越来越重要的角色,并成为一种主要社会力量,逐步形成了“政府—市场—行业协会”多中心治理结构。在多中心治理理论的影响下,到了20世纪90年代,一些发达国家纷纷在治理运行机制上采用了公私合作、服务外包、民营化、去规制化、绩效评估等政策手段,更加重视构建政府与行业协会良性互动的关系。本文第一章对国内外关于地方政府与行业协会之间关系的文献进行研究,厘清国内外地方政府与行业协会的关系,目前地方政府与行业协会的关系模式主要有政府主导模式、行业协会主导模式、并存模式和合作模式。第二章对非政府组织和行业协会的概念进行界定,行业协会作为非政府组织的一种形式,它具有以下几个特点:1、协会的会员致力于某一个共同目标;2、协会的经费自筹,不过分依赖政府;3、从事一些个别企业会员难以完成的事;4、协会的主要目标不在于获利润,不是以营利为目的;5、会员互惠互利,协会通过对会员和社会的有偿服务收入维持协会的发展。第三章以南海铝型材行业协会作为实例,阐述其发展状况、功能、与南海地方政府的互动关系现状,南海地方政府与铝型材行业协会的关系是“合作的卖者”,并进一步分析两者在互动关系中存在的问题,包括机制瓶颈,管理错位和政会职能不明晰。第四章分析制约政会间良性互动关系建立的因素,包括观念因素、事权因素、利益因素、制度因素和协会自身因素。第五章是建立地方政府与南海铝型材行业协会良性互动关系的出路思考,提出了四种政会间的关系模式:委托代理模式、凭单制、授权监理模式和合同外包制,并对这四种模式进行了操作性探讨。

【Abstract】 Since the 70s of the 20th century, the countries and the regions in the word have the "market failure" and "government failure" phenomenon. In the situation of "government failure" and "market failure", only "the third hand" can solve the problem. As self-organized voluntary organizations, the third sector makes up the shortage of the government and the market. It attracted widespread attention by their unique non-profit. As a form of non-profit organization, the Trade Promotion Association makes up the market and the government’s inadequate supply of public goods, and as a major social force, it plays an increasingly important role in public services and public administration. Gradually, a polycentric governance structure of "government - the market– trade promotion association" comes out. Under the influence of the“multi-cente”governance theory, in the 90s of the 20th century, some developed countries have positive interaction in the governance mechanism, such as public-private partnerships, outsourcing, privatization, remove reguration, performance evaluation and other policy instruments. They play more attention to structure the positive interation of the government and the Trade Promotion Association.The first chapter researches on the relationship between Trade Promotion Association and local government at home and abroad, and clarifies the relationship between Trade Promotion Association and local government. At present, the model includes government-led, trade promotion association-led, coexistence model and cooperation. The second chapter defines the concept of the non-governmental organizations and Trade Promotion Association. As a form of non-governmental organizations, Trade Promotion Association has the following characteristics: one, the association’s members are committed to one common goal; two, the association is self-financing,not overly depends on government; three, the association engages what some individual member companies can not do; four, the association’s main goal is not for profit, is non-profit; five, members of mutual benefit, the association sustain development through paid services for the members and the society. Chapter Three takes the NAPA①as a case study, and explains its development, function, and interaction between the local government, the relationship between the local government and the NAPA "the seller of cooperation", and further analyzes the interaction problems of the two, including the mechanism of the bottleneck, the management functions of dislocation and the function of the two is not clear. The fourth chapter analyzes the factors that restrict establishing the positive interation of the two, including the concept of factors, powers of factors, interest factors, institutional factors and association’s own factors. The fifth chapter discusses the positive interation’s establishment of local government and the NAPA, and propses four models: principal-agent model, the voucher system, authorization-supervision model, and Contracting-out Mechanism, and further conductes against the four models’feasibility study.
