【摘要】 我国人口年龄结构老龄化的趋势,必然要求关注农民养老保障问题。养老保障中出现的城乡差别、群体差异、地区差距等问题,不仅需要政策手段、经济手段加以解决,而且更需要运用宪法和法律手段进行通盘考虑。农村养老保障所涉及的人权价值、平等权实现、国家权力配置和国家制度供给等问题,归根结底是一个宪法问题,即国家权力如何保障公民权利实现的问题。这是宪法的永恒主题。从宪法学视角看,农民养老保障权是一种复合型的权利,是指农民在满足自己生存需要前提下,要求在政治上获得同城镇居民一样享有平等待遇的一种权利,这种权利的内容是公民在年老时获得国家物质帮助。因此,农民养老保障权是现代宪政的内在要求,农民养老保障权是生存权的表征,农民养老保障权更是平等权的体现,农民养老保障权最终是农民获得国家物质帮助的权利。农民养老保障权具有基本权利的效力,它能对立法机关、行政机关和司法机关的行为产生拘束力。我国现行农民养老保障制度存在城乡差别明显、立法价值选择显失公平、制度供给不足和农民维权意识淡薄等明显缺陷。反观发达国家,养老保障是国家的一项基本义务,它由比较完善的法律体系加以平等保障和实现农民的养老保障权。鉴于此,促进我国农民养老保障权的实现,必须纠正立法价值选择的偏差,建立健全农民养老保障的法律体系和配套法规,并不断强化政府养老保障责任以及农民的权利观念。更多还原

【Abstract】 With the trend of population age structure in china continued growing old, it necessarily require us take attention to the problem about old-age security for peasantry. The issue which still beset in old-age security is the gap between rural-urban, group and region. To solve it, we need, not only by policy or economy, but an overall consideration on constitutional law and legislation. The peasantry’s old-age security includes human values, equal rights, authority of state allocation and supply of state institution. All this, after all, is the issue of constitutional law that how State power to achieve the civil rights, and this is the eternal theme of constitutional law.From the perspective of constitutional law, peasantry’s old-age security is a composite right which not only meet peasantry survival needs, but also seek equal political rights with city dwellers, and to obtain material assistance from the state when they getting old. Consequently, peasantry’s old-age security is the inner requirement of modern constitutionalism; it is even more embodiment of equal right and help peasantry to attain national material assistance in the end. Peasantry’s old-age security possesses fundamental right which can bind the behavior of legislative, executive, and judicial branches.The present old-age security systems in our country have obvious deficiency as the sharp difference between the city and countryside, the evident inequity selection on legislation value, the shortage of employment-promotion policy and the flimsy awareness of the peasantry. In developed country, old-age security is the main obligation which support by relative consummate legal system and guarantee peasantry’s right. To promote peasantry’s old-age security system in our country we should, therefore, to correct the deviate selection on legislation value, to establish and improve legal system and relevant rules on peasantry’s old-age security, and unceasingly strengthens peasantry’s rights concepts.更多还原
