【摘要】 农村土地承包经营权是指农村居民以家庭为承包单位,依据法律规定和合同约定对集体所有的土地享有占有、使用、收益的权利。农村土地承包经营权托管是指农村土地承包经营权人为了有效利用土地,以获取收益为目的,基于对受托人的信任通过合同方式将土地承包经营权委托给受托人,受托人以自己的名义依照托管合同的约定提供相应的土地经营管理服务的一种民事行为。农村土地承包经营权托管是土地承包经营权流转的新方式,是农村土地承包经营权流转实践中群众智慧的结晶,它的出现具有现实的历史背景。目前托管的类型主要包括农业综合开发协会模式、专业合作社模式、公司模式等。托管的内容主要由委托人权利义务与受托人权利义务两方面构成。农村土地承包经营权托管具有补充和完善农村土地基本经营制度,提高农作物产量,增加农民收入,提高农民组织化程度等优势,能够弥补其它农村土地承包经营权流转方式的不足。但正如一枚硬币有正、反两面一样,农村土地承包经营权托管亦有缺陷和不足,其存在操作不规范、欠缺专门规制的法律法规、缺乏完备的中介服务组织等问题。基于目前我国农村土地承包经营权托管的现状,建议从制定相关立法,规范农村土地承包经营权托管合同的订立和履行,制定农村土地承包经营权托管的登记与公示制度,加强对农村土地承包经营权托管的监管,成立农村土地承包经营权托管服务中心等方面对其进行规制和完善。更多还原

【Abstract】 Contracted management of rural land is the rights of possession use and proceeds which farmers, rural family as a contract unit,have within the law and the contract to the land, which the collectivity own. The trusteeship of contracted management of rural land is a civil act that with the purpose of effective use of land to obtain benefit, the holder of the right to the contracted management of land transfers the contracted management of rural land to the trustee by contract based on the trust of the trustee, and after the acquisition of the contracted management of rural land, according to the contract engagement the trustee offers relative land management service in his own name.Trusteeship of contracted management of rural land is a new way of circulation of contracted management of rural land and the crystallization of group in the circulation practice,the emergence of it have the realistic historical background.Current trusteeship pattern mainly includes agricultural comprehensive development association, the professional cooperatives, company.etc. The content of trusteeship mainly consist of the rights and obligations of the client and the trustee.Trusteeship of contracted management of rural land have the advantage of supplementing and perfecting the basic management system of rural land, increasing crop yields and the farmers’ income, improving the degree of organization of farmers,compensating for the shortage of other circulation way of rural contracted land.However,Just as a coin has positive and reverse sides,the trusteeship of contracted management of rural land also have disadvantages,such as improper operation, lack of special regulations, and completely intermediary service organization, etc. Based on the present situation of trusteeship of contracted management of rural land,I suggest through the following ways to regulate and perfect it,such as draw up relative legislation,regulate the formation and perform of trusteeship contract,formulate the system of registration and public, strengthen the supervision,found up the service center of trusteeship of contracted management of rural land and supply the legal services.更多还原
