【摘要】 农村宅基地使用权的法律问题研究具有重要的理论价值和实践意义。农村宅基地使用权在我国发挥着独特的作用,承载着农民居住的社会保障功能。当前我国的立场是严格限制宅基地使用权的流转,但现实中却存在着普遍流转的现象。这不仅体现了现实中流转的需求,更体现了规避现行法的流转行为有其合理性。农村宅基地使用权的流转是我国现实存在的一个难题,并且随着我国城镇化快速发展,农村宅基地使用权的流转也是一个趋势。宅基地的流转不仅涉及我国现行法的规定和土地政策,而且还涉及农村村民的保障和社会的稳定。通过对农村宅基地使用权流转的法律问题研究,有助于形成正确的认识并对实践给予正确的指导。本文立足于我国当前限制流转的立场,通过放宽宅基地使用权流转的条件,构建宅基地使用权有限流转制度。结合我国政策、法律规定等当前立场,本文通过对我国现行农村宅基地使用权流转的现状分析,探讨流转过程中面临的法律问题,分析流转的原因和可行性,并为我国农村宅基地使用权流转制度的构建提出建议。论文大体为三部分:第一部分是关于我国农村宅基地使用权流转的概述。首先,结合我国土地制度,分析建国后我国农村宅基地制度的产生和发展历程;通过对农村宅基地的概念、性质、法律特征的学理分析,形成初步认识。其次,通过对农村宅基地使用权的取得、流转、消灭以及登记的分析,明确我国现行法上的立场。第二部分是关于我国农村宅基地使用权制度的现状分析。首先,通过对当前几种典型流转方式的分析,看到在法律严格限制流转的前提下,各地普遍存在的流转行为以及对流转行为的不同观点。其次,通过对农村宅基地使用权流转的现实困境进行分析,得出流转的原因主要有:体制上的原因、法律上的原因和管理上的原因。第三部分是我国农村宅基地使用权流转制度的构建。首先,指出我国农村宅基地使用权流转的可行性,在自由流转说、有限流转说和禁止流转说三种学说中坚持有限流转说。进一步分析流转必须解决的几个问题和当前存在的流转空间。其次,根据有限流转说,放宽流转的条件,构建我国的农村宅基地使用权流转制度。从规范取得制度、规范取得行为、建立流转收益分配机制来构建流转的法律制度。加强宅基地使用权管理,坚持流转必须符合土地利用规划、严格审批、加强宅基地的整理。另外,还有加强相关制度的建立,比如农村社会保障制度、统一登记制度。更多还原

【Abstract】 Research of the legal issue on the transfer of the rural homestead usufruct is of great theoretical value and practical significance. In China, the rural homestead usufruct plays a unique role, which is carrying the social security function for the farmers. That the transfer of the rural homestead usufruct is strictly limited is our current standpoint, but there is a general phenomenon of the transfer. It reflects the needs of reality and the reasonableness of the transfer which fudges on the current law. The transfer of the rural homestead usufruct is a problem in reality, and the transfer is a trend with the rapid development of China’s urbanization. The transfer of the rural homestead usufruct is not only related to the current law and land policy, but also related to the security of rural villagers and the social stability. Research of the legal issue on the transfer of the rural homestead usufruct contributes to forming an opinion and guiding to practice correctly. This article is based on our current standpoint of the limited transfer and tries to establish the system of the limited circulation of homestead usufruct by relaxing the conditions of transfer.Combined with our current standpoint such as the policy and legal provisions,the article analyzes the present situation of the transfer of the rural homestead usufruct, discusses the legal issues on transfer, assays the reason and the feasibility of transfer, and makes recommendations on the transfer system of the rural homestead usufruct . The body of the article is divided into three parts:The first part is about the overview on the transfer of the rural homestead usufruct in China. For one thing, we format a preliminary understanding, through analyzing the process of found and development、the conception、the nature and the legal characteristics of the rural homestead usufruct, combined with China’s land system. For another thing, we finalize our current position on current law, through analyzing the acquisition、the circulation、the elimination and the registration of the rural homestead usufruct.The second part is about the analysis of the present situation of the rural homestead usufruct. For one thing, through the analysis of the current transfer behaviors, we can see that there is a so common phenomenon of the transfer under the premise of strictly limited transfer behavior by law, but so different views on it. For another thing, through the analysis of the current plight of the rural homestead usufruct, we can find the reasons for transfer mainly include: the institutional reason, the legal reason and the administrative reason.The third part is about the construction of the transfer system of the rural homestead usufruct. For one thing, the article shows the feasibility of the transfer of the rural homestead usufruct, insists the limited circulation among the limited circulation、the prohibited circulation and the free circulation, and makes a further analysis of the space of the transfer and the question in transferring. For another thing, according to the limited circulation to relax the condition, the transfer system of the rural homestead usufruct should be constructed. The legal system should be constructed by regulating the acquisition system、regulating the behavior of acquisition and establishing a mechanism of the circulation income distribution. Strengthen management. The transfer of the rural homestead usufruct must be conformed to land use plan, strict with the procedure for examination and approval and persist in homestead consolidation.
